A licensed or unlicensed midwife shall disclose verbally and\n\nin written form to a prospective client at the outset of the\n\nprofessional relationship:\n\n1. Which credential the midwife possesses, if any;\n\n2. The limitations of the skills and practices of a midwife;\n\n3. Whether the midwife carries malpractice insurance; and\n\n4. A plan for emergencies and complications to include\n\nselection of a hospital in case of emergency.\n\nB. The Advisory Committee on Midwifery shall prescribe the form\n\nof the informed choice and disclosure statement required to be used\n\nby a licensed or unlicensed midwife under this act. The form shall\n\nbe posted on the website of the Department and shall include:\n\n1. Credential of the midwife, if any;\n\n2. Disclosure of experience as a midwife;\n\n3. The date the license expires, if the midwife is licensed;\n\n4. Documentation of compliance with continuing education\n\nrequirements, if the midwife is licensed;\n\n5. A description of the transfer or referral strategy;\n\n6. Direction on where to find the scope of practice standards\n\nof a licensed midwife, as provided by rules of the State\n\nCommissioner of Health; and\n\n7. Additional informed choice and disclosure statements\n\napproved by the Committee and provided by rule specific to vaginal\n\nbirth after Caesarean (VBAC), vaginal breech birth and vaginal\n\nmultiple birth.\n\nC. The informed choice and disclosure statement shall include a\n\nnotification that state law requires a newborn to be tested for\n\ncertain heritable disorders and hypothyroidism, in the absence of a\n\nsigned parental waiver from the State Department of Health.\n\nD.
