The State Commissioner of Health is hereby authorized to\n\npromulgate rules, pursuant to the Administrative Procedures Act,\n\nthat the Commissioner deems necessary for the implementation and\n\nenforcement of Shepherd's Law including, but not limited to:\n\n1. Scope of practice;\n\n2. A formulary of prescription drugs that a licensed midwife\n\nmay obtain, transport and administer when providing midwifery\n\nservices;\n\n3. A list of routine tests and procedures for which informed\n\nconsent or refusal must be obtained;\n\n4. Qualifications for licensure;\n\n5. Renewals and reinstatements;\n\n6. Fees;\n\n7. Continuing education requirements;\n\n8. Complaints;\n\n9. Violations; and\n\n10. Penalties.\n\nIn so doing, the Commissioner shall give utmost consideration to\n\nthe recommendations of the Advisory Committee on Midwifery as\n\ncreated in Section 5 of this act.\n\nB. The Commissioner shall have the power to, for good cause and\n\nin accordance with the Administrative Procedures Act:\n\n1. Deny, revoke or suspend any license to practice midwifery;\n\n2. Develop a schedule of fines and penalties not to exceed Five\n\nThousand Dollars ($5,000.00); and\n\n3. Otherwise discipline a licensee.\n\nC. As used in this section, good cause shall include, but not\n\nbe limited to:\n\n1. Violation of Shepherd's Law; or\n\n2. Denial, revocation or suspension of the midwife's\n\ncertification, assessment of a penalty or imposition of other\n\ndisciplinary action by the North American Registry of Midwives, the\n\nAmerican Midwifery Certification Board or a successor organization\n\napproved by the Commissioner.\n\nD.
