There is hereby created, to continue until July 1, 2026, an\n\nAdvisory Committee on Midwifery, which shall consist of seven (7)\n\nvoting members to be appointed by the State Commissioner of Health\n\nas follows:\n\n1. Three licensed midwives, each of whom has at least three (3)\n\nyears of experience in the practice of midwifery;\n\n2. One Certified Nurse-Midwife;\n\n3. One physician who is certified by a national professional\n\norganization of physicians that certifies obstetricians and\n\ngynecologists and supports the practice of midwifery;\n\n4. One physician who is certified by a national professional\n\norganization of physicians that certifies family practitioners or\n\npediatricians and supports the practice of midwifery; and\n\n5. One member of the general public who is not practicing or\n\ntrained in a health care profession, and who is a parent with at\n\nleast one child born with the assistance of a licensed midwife or a\n\nCertified Nurse-Midwife.\n\nB. Members of the Committee shall be divided into three\n\nclasses. The initial terms of the first class shall expire on\n\nJanuary 31, 2023, and subsequent terms shall expire on January 31 of\n\neach sixth year thereafter. The initial terms of the second class\n\nshall expire on January 31, 2025, and subsequent terms shall expire\n\non January 31 of each sixth year thereafter. The initial terms of\n\nthe third class shall expire on January 31, 2027, and subsequent\n\nterms shall expire on January 31 of each sixth year thereafter.\n\nMembers shall serve until a qualified successor has been duly\n\nappointed. The Commissioner shall fill a vacancy no later than\n\nsixty (60) days from the date the vacancy occurs. No person shall\n\nbe appointed to serve more than two (2) consecutive terms.\n\nC. The Committee shall annually elect a chair and vice-chair\n\nfrom among its members.\n\nD. The Committee shall meet at least semiannually and at any\n\nother time at the call of the chair or the Commissioner.\n\nE. The Committee shall meet in accordance with the Oklahoma\n\nOpen Meeting Act.\n\nF. A majority of the members of the Committee, including at\n\nleast two licensed midwives, shall constitute a quorum for the\n\nconduct of Committee business.\n\nG. 1. The Committee shall advise the Commissioner on all\n\nmatters pertaining to midwifery including but not limited to:\n\na. scope and standards of practice,\n\nb. licensure requirements, examination requirements,\n\nexceptions thereto, renewal requirements, temporary\n\nlicensure and endorsement or reciprocity requirements,\n\nc. methods and requirements for ensuring the continued\n\ncompetence of licensed and registered persons\n\nincluding the type of courses and number of hours\n\nrequired to meet the basic midwifery education course\n\nand continuing midwifery education course\n\nrequirements, and instructors or facilities used in\n\nthe basic and continuing education requirements,\n\nd. procedures for reporting of outcomes including, but\n\nnot limited to, live births and fetal, newborn or\n\nmaternal deaths,\n\ne. grounds for reporting and processing complaints,\n\nviolations, probation, revocation or suspension of\n\nlicense or reinstatement provisions, and\n\nf. all other matters which may pertain to the practice of\n\nmidwifery.\n\n2. The Committee shall review and make recommendations to the\n\nCommissioner on all applications for licensure.\n\n3. The Committee shall assist and advise the Commissioner in\n\nall hearings related to the enforcement of Shepherd's Law.
