Regardless of any other law governing the imposition of\n\ninterest, fees, loan finance charges or the extension of credit, a\n\ndeferred deposit lender may charge a finance charge for each\n\ndeferred deposit loan that does not exceed Fifteen Dollars ($15.00)\n\nfor every One Hundred Dollars ($100.00) advanced up to the first\n\nThree Hundred Dollars ($300.00) of the amount advanced; for the\n\nadvance amounts in excess of Three Hundred Dollars ($300.00), the\n\nlender may charge an additional finance charge of Ten Dollars\n\n($10.00) for every One Hundred Dollars ($100.00) advanced in excess\n\nof Three Hundred Dollars ($300.00). The credit terms of the\n\ndeferred deposit loan shall be disclosed in accordance with\n\nRegulation Z, including the terms “finance charge” and “annual\n\npercentage rate”. The finance charge under this subsection shall be\n\ndeemed fully earned as of the date of the transaction. Except for a\n\nfee for a dishonored instrument and the actual database verification\n\nfee pursuant to subparagraph b of paragraph 2 of subsection B of\n\nSection 3109 of this title, the lender may charge only those charges\n\nexpressly authorized in this subsection in connection with a\n\ndeferred deposit loan.\n\nB. If an instrument held by a lender as a result of a deferred\n\ndeposit loan is returned to the lender from a payor financial\n\ninstitution due to insufficient funds, a closed account or a stop\n\npayment order, the lender shall have the right to exercise all civil\n\nmeans authorized by law to collect the amount of the instrument. In\n\naddition, the lender may contract for and collect a dishonored\n\ninstrument charge, not to exceed Twenty-five Dollars ($25.00);\n\nhowever, a dishonored instrument charge shall not be allowed if the\n\ninstrument is dishonored by a financial institution, or the debtor\n\nplaces a stop payment order, due to forgery or theft of the\n\ninstrument.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e55b08f3b82523247c73eeb88f9e9d415305cd24808c9bda0379586b9d06fc81","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-3107","next":"us-ok/okla.-stat.-tit.-59-59-3109"},"notice":"GroundRules: Original legal text.
