Pursuant to and in compliance with Article I of the\n\nAdministrative Procedures Act, the Board of Dentistry shall have the\n\npower to formulate, adopt, and promulgate rules as may be necessary\n\nto regulate the practice of dentistry in this state and to implement\n\nand enforce the provisions of the State Dental Act.\n\nB. The Board is authorized and empowered to:\n\n1. Examine and test the qualifications of applicants for a\n\nlicense or permit to be issued by the Board;\n\n2. Affiliate by contract or cooperative agreement with another\n\nstate or combination of states for the purpose of conducting\n\nsimultaneous regional examinations of applicants for a license to\n\npractice dentistry, dental hygiene, or a dental specialty;\n\n3. Maintain a list of the name, current mailing address and\n\nofficial address of all persons who hold a license or permit issued\n\nby the Board;\n\n4. Account for all receipts and expenditures of the monies of\n\nthe Board including annually preparing and publishing a statement of\n\nreceipts and expenditures of the Board for each fiscal year;\n\n5. Within limits prescribed in the State Dental Act, set fees\n\nand administrative penalties to be imposed and collected by the\n\nBoard as provided by rules;\n\n6. Employ an Executive Director, legal counsel and other\n\nadvisors to the Board including advisory committees;\n\n7. Investigate and issue investigative and other subpoenas,\n\npursuant to Article II of the Administrative Procedures Act;\n\n8. Initiate individual proceedings and issue orders imposing\n\nadministrative penalties, pursuant to Article II of the\n\nAdministrative Procedures Act, against any dentist, dental\n\nhygienist, dental assistant, oral maxillofacial surgery assistant,\n\ndental laboratory technician, or holder of a permit to operate a\n\ndental laboratory who has violated the State Dental Act or the rules\n\nof the Board;\n\n9. Conduct, in a uniform and reasonable manner, inspections of\n\ndental offices and dental laboratories and business records of\n\ndental offices and dental laboratories;\n\n10. Establish guidelines for courses of study necessary for\n\ndental assistants, oral maxillofacial surgery assistants and, when\n\nappropriate, issue permits authorizing dental assistants or oral\n\nmaxillofacial surgery assistants to perform expanded duties;\n\n11. Establish continuing education requirements for dentists,\n\ndental hygienists, dental assistants and oral maxillofacial surgery\n\nassistants who hold permits issued by the Board;\n\n12. Recognize the parameters and standards of care established\n\nand approved by the American Dental Association or another\n\nnationally recognized medical or dental association that establishes\n\nguidelines for health care as it relates to dentistry. The Board\n\nshall have the sole authority to determine scope of practice of\n\nlicensees considering these standards and guidelines;\n\n13. Formulate, adopt, and promulgate rules, pursuant to Article\n\nI of the Administrative Procedures Act, as may be necessary to\n\nimplement and enforce the provisions of the Oklahoma Dental\n\nMediation Act;\n\n14. Seek and receive advice and assistance of the Office of the\n\nAttorney General of this state;\n\n15. Promote the dental health and the education of dental\n\nhealth of the people of this state;\n\n16. Inform, educate, and advise all persons who hold a license\n\nor permit issued by the Board, or who are otherwise regulated by the\n\nBoard, regarding the State Dental Act and the rules of the Board;\n\n17. Affiliate with the American Association of Dental Boards as\n\nan active member, pay regular dues, and send members of the Board as\n\ndelegates to its meetings;\n\n18. Enter into contracts;\n\n19. Acquire by purchase, lease, gift, solicitation of gift or\n\nby any other manner, hold, encumber, and dispose of personal\n\nproperty as is needed, maintain, use and operate or contract for the\n\nmaintenance, use and operation of or lease of any and all property\nal Boards as\n\nan active member, pay regular dues, and send members of the Board as\n\ndelegates to its meetings;\n\n18. Enter into contracts;\n\n19. Acquire by purchase, lease, gift, solicitation of gift or\n\nby any other manner, hold, encumber, and dispose of personal\n\nproperty as is needed, maintain, use and operate or contract for the\n\nmaintenance, use and operation of or lease of any and all property\n\nof any kind, real, personal or mixed or any interest therein unless\n\notherwise provided by the State Dental Act; provided, all contracts\n\nfor real property shall be subject to the provisions of Section 63\n\nof Title 74 of the Oklahoma Statutes;\n\n20. Receive or accept the surrender of a license, permit, or\n\ncertificate granted to any person by the Board as provided in\n\nSection 328.44b of this title; and\n\n21.
