No person shall practice as a dental assistant without first\n\napplying for and obtaining a permit from the Board of Dentistry.\n\nB. The application shall be made to the Board in writing and\n\nshall be accompanied by the fee established by the Board, together\n\nwith satisfactory proof that the applicant passes a background check\n\nwith criteria established by the Board.\n\nC. Every dental assistant receiving a permit shall complete a\n\nclass on infection control as approved by the Board within one (1)\n\nyear from the date of receipt of the permit. Failure to complete\n\nthe class shall be grounds for discipline pursuant to Section\n\n328.29a of this title.\n\nD. There shall be eight types of expanded duty permits\n\navailable for dental assistants upon completion of a program\n\napproved by the Commission on Dental Accreditation (CODA) or a\n\ncourse that has been approved by the Board:\n\n1. Radiation safety;\n\n2. Coronal polishing and topical fluoride;\n\n3. Sealants;\n\n4. Assisting in the administration of nitrous oxide;\n\n5. Phlebotomy;\n\n6. Venipuncture;\n\n7. Elder care and public health; or\n\n8. Oral maxillofacial surgery. An oral maxillofacial surgery\n\nexpanded duty permit shall be available to a dental assistant who\n\nhas met the requirements as listed in Section 328.25 of this title\n\nand assists a dentist, pediatric dentist, or oral maxillofacial\n\nsurgeon who holds a parenteral or general anesthesia permit;\n\nprovided, only the dentist, pediatric dentist, or oral maxillofacial\n\nsurgeon, or an anesthesiologist or a Certified Registered Nurse\n\nAnesthetist, may administer anesthesia and assess the patient’s\n\nlevel of sedation and only the dentist, pediatric dentist, or oral\n\nmaxillofacial surgeon may perform surgery.\n\nAll expanded duties shall be added to the dental assistant\n\npermit upon approval by the Board.\n\nE. The training requirements for all expanded duty permits\n\nshall be set forth by the Board. A program that is not CODA-\n\ncertified must meet the standards set forth and be approved by the\n\nBoard.\n\nF. An applicant for a dental assistant permit who has graduated\n\nfrom a dental assisting program accredited by CODA and has passed\n\nthe jurisprudence examination shall receive all expanded duty\n\npermits provided for in subsection D of this section if the course\n\nmaterials approved by the Board are covered in the program.\n\nG. A dental assistant who holds an out-of-state dental\n\nassistant permit with expanded duties may apply for credentialing\n\nand reciprocity for a dental assistant permit including any expanded\n\nduty by demonstrating the following:\n\n1. The dental assistant has had a valid dental assistant permit\n\nin another state for a minimum of two (2) years and is in good\n\nstanding;\n\n2. The dental assistant has had a valid expanded duty in\n\nanother state for a minimum of one (1) year; and\n\n3. The dental assistant provides a certificate or proof of\n\ncompletion of an educational class for the expanded duty and that\n\nthe dental assistant has been providing this treatment to dental\n\npatients while working as a dental assistant in a dental office for\n\none (1) year.\n\nH. Any person having served in the military as a dental\n\nassistant shall receive credentialing and reciprocity for expanded\n\nfunctions by demonstrating the following:\n\n1. Proof of military service in excess of two (2) years with\n\nany certifications or training in the expanded function areas; and\n\n2.
