Stat. tit. 59, § 59-328.29a","heading":"Dental assistant – Revocation or suspension of permit,","body":"probation or censure – Reinstatement – Definitions.\n\nA. The following acts or occurrences by a dental assistant\n\nshall constitute grounds for which the penalties specified in\n\nSection 328.44a of this title may be imposed by the Board of\n\nDentistry or be the basis for denying a new applicant any license or\n\npermit issued by the Board:\n\n1. Any of the causes now existing in the laws of this state;\n\n2. A violation of the provisions of the State Dental Act; or\n\n3. A violation of the rules of the Board promulgated pursuant\n\nto the State Dental Act.\n\nB. The Board shall also have the power to act upon a petition\n\nby a dental assistant for reinstatement to good standing. The Board\n\nshall keep a record of the evidence and proceedings in all matters\n\ninvolving the revocation or suspension of a permit, censure or\n\nprobation of a dental assistant. The Board shall make findings of\n\nfact and a decision thereon. Notification of the licensee or permit\n\nholder shall occur pursuant to Section 328.21 of this title.\n\nC. The decision shall be final unless the dental assistant\n\nappeals the decision as provided by the State Dental Act.\n\nD. The Board shall have power to revoke or suspend the permit,\n\ncensure, or place on probation a dental assistant for a violation of\n\none or more of the following:\n\n1. Pleading guilty or nolo contendere to, or being convicted\n\nof, a felony crime that substantially relates to the occupation of a\n\ndental assistant and poses a reasonable threat to public safety, or\n\na violation of federal or state controlled dangerous substances\n\nlaws;\n\n2. Presenting to the Board a false application or documentation\n\nfor a permit;\n\n3. Being, by reason of persistent inebriety or addiction to\n\ndrugs, incompetent to continue to function as a dental assistant;\n\n4. Functioning outside the direct or direct visual supervision\n\nof a dentist;\n\n5. Performing any function prohibited by Chapter 15 of the\n\nOklahoma Administrative Code or any violation that would be a\n\nviolation for a dentist or hygienist under Section 328.32 or 328.33\n\nof this title, or any other duty not assignable to a dental\n\nassistant; or\n\n6. Failure to secure an annual registration as specified in\n\nSection 328.41 of this title.\n\nE. The Board’s review panel, as set forth in Section 328.43a of\n\nthis title, upon concurrence with the president of the Board, may\n\ndetermine that an emergency exists to temporarily suspend the permit\n\nof a dental assistant if the panel finds that public health, safety\n\nor welfare imperatively requires emergency action. The panel may\n\nconduct a hearing pursuant to Section 314 of Title 75 of the\n\nOklahoma Statutes for the temporary suspension.\n\nF. As used in this section:\n\n1. “Substantially relates” means the nature of criminal conduct\n\nfor which the person was convicted has a direct bearing on the\n\nfitness or ability to perform one or more of the duties or\n\nresponsibilities necessarily related to the occupation; and\n\n2. “Poses a reasonable threat” means the nature of criminal\n\nconduct for which the person was convicted involved an act or threat\n\nof harm against another and has a bearing on the fitness or ability\n\nto serve the public or work with others in the occupation.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bf69264b59afad0ebdbdac05c7eefd9ecf08c86ed73611cb527df9d943db94bf","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-328.28a","next":"us-ok/okla.-stat.-tit.-59-59-328.3"},"notice":"GroundRules: Original legal text.
