Stat. tit. 59, § 59-328.41","heading":"Renewal certificate - Continuing education requirements","body":"– Fee - Automatic cancellation.\n\nA. 1. On or before the last day of December of each year,\n\nevery dentist, dental hygienist, dental assistant, and other\n\nlicensee or permit holders previously licensed or permitted by the\n\nBoard of Dentistry to practice in this state, with the exception of\n\nthose listed in paragraph 2 of this subsection, shall submit a\n\ncompleted renewal application with information as may be required by\n\nthe Board, together with an annual renewal fee established by the\n\nrules of the Board. Upon receipt of the annual renewal fee, the\n\nBoard shall issue a renewal certificate authorizing the dentist,\n\ndental hygienist, or dental assistant to continue the practice of\n\ndentistry or dental hygiene, respectively, in this state for a\n\nperiod of one (1) year. Every license or permit issued by the Board\n\nshall begin on January 1 and expire on December 31 of each year.\n\n2. Resident and fellowship permits shall be valid from July 1\n\nthrough June 30 of each year and dental student intern permits shall\n\nbe valid from August 1 through July 31 of each year.\n\nB. Continuing education requirements shall be due at the end of\n\neach two-year period.\n\nC. 1. Continuing education requirements for a dentist or\n\ndental hygienist shall consist of:\n\na. a live, in-person cardiopulmonary resuscitation class\n\napproved by the Board,\n\nb. an ethics class approved by the Board,\n\nc. for a dentist, two (2) hours of opioid and scheduled\n\ndrug prescribing classes, and\n\nd. any combination of the following:\n\n(1) completion of classes at a university, college or\n\ntechnology center school accredited by the\n\nCommission on Dental Accreditation (CODA) or\n\ncollege courses related to dentistry, which shall\n\ncount equal to credit hours received on a\n\ntranscript,\n\n(2) teaching one or more classes at a school or\n\nprogram accredited by CODA, for which the dentist\n\nor dental hygienist shall receive credit for the\n\nsemester credit hours and one (1) hour of credit\n\nper eighteen (18) hours of clinical instruction,\n\n(3) publishing papers, presenting clinics and\n\nlecturing, for which the dentist or dental\n\nhygienist shall receive six (6) credit hours for\n\neach hour of the original presentation and hour-\n\nfor-hour credit for a subsequent presentation of\n\nthe same material. No more than fifty percent\n\n(50%) of total required continuing education\n\nhours may be fulfilled by activities described in\n\nthis division,\n\n(4) a scientific-based medical treatment and patient\n\ncare class approved by the Board,\n\n(5) any health-related program sponsored by the\n\nUnited States Department of Veteran Affairs or\n\nArmed Forces provided at a government facility,\n\n(6) formal meetings by national or state professional\n\norganizations for dental providers, or\n\nuniversity-sponsored professional alumni clinical\n\nmeetings approved by the Board,\n\n(7) organized study clubs,\n\n(8) uncompensated volunteer work at an event approved\n\nby the Board not to exceed seven (7) hours for a\n\ndentist or four (4) hours for a dental hygienist,\n\nor\nfessions and Occupations Page 257\n\n(6) formal meetings by national or state professional\n\norganizations for dental providers, or\n\nuniversity-sponsored professional alumni clinical\n\nmeetings approved by the Board,\n\n(7) organized study clubs,\n\n(8) uncompensated volunteer work at an event approved\n\nby the Board not to exceed seven (7) hours for a\n\ndentist or four (4) hours for a dental hygienist,\n\nor\n\n(9) practice-management-related courses not to exceed\n\nfour (4) hours for a dentist or two (2) hours for\n\na dental hygienist.\n\n2. Full-time graduate study, internships, residencies and\n\ndentists and dental hygienists engaged in a full-time program\n\naccredited by CODA shall be exempt from continuing education for a\n\ncontinuing education year per academic year completed.\n\n3. New graduates of dental and hygiene programs shall not be\n\nrequired to complete continuing education for the first year after\n\ngraduation. Continuing education requirements for dentists and\n\ndental hygienists who are new graduates shall begin July 1 of the\n\ncalendar year following the year of graduation. Hours shall be\n\nprorated by year of new licensure.\n\n4. A dentist or dental hygienist on active duty military\n\nservice shall be exempt from continuing education if he or she is:\n\na. currently on full-time active duty service as a\n\ndentist or dental hygienist for a minimum of eighteen\n\n(18) months in a two-year continuing education cycle\n\nand is deployed outside of the United States, or\n\nb. a licensed dentist or dental hygienist serving in the\n\nreserve components of the armed forces as specified in\n\n10 U.S.C., Section 10101, who is actively deployed\n\noutside of the United States for a minimum of eighteen\n\n(18) months in a two-year continuing education cycle.\n\nD. 1. Dentists shall complete forty (40) hours of continuing\n\neducation with no more than twenty (20) hours to be completed\n\nonline. Dental hygienists shall complete twenty (20) hours of\n\ncontinuing education with no more than ten (10) hours to be\n\ncompleted online. Interactive classes or webinar classes may, at\n\nthe discretion of the Board, count as in-person.\n\n2. Dental assistants with an oral maxillofacial expanded duty\n\npermit shall complete eight (8) hours of continuing education\n\nincluding one (1) hour of infection control.\n\n3. All other dental assistants shall complete two (2) hours of\n\ninfection control.\n\n4. Any newly licensed dentist shall complete a two-hour opioid\n\nand scheduled drug prescribing class within one (1) year of\n\nobtaining licensure.\n\nE. Upon failure of a dentist, dental hygienist, or dental\n\nassistant to pay the annual renewal fee within two (2) months after\n\nJanuary 1 of each year, the Board shall notify the dentist, dental\n\nhygienist, dental assistant, or other permit holder that the license\n\nor permit will be officially canceled as of April 1 pursuant to\n\nsubsection M of Section 328.21 of this title. A list of canceled\n\nlicenses or permits not otherwise renewed shall be published at the\n\nfollowing meeting of the Board.\n\nF. Any dentist, dental hygienist, or dental assistant whose\n\nlicense or permit is automatically canceled by reason of failure,\n\nneglect or refusal to secure the renewal certificate may be\n\nreinstated by the Board at any time within five (5) years from the\n\ndate of the expiration of the license, upon payment of the annual\n\nrenewal fee and a penalty fee established by the rules of the Board.\n\nThe Board may require any training or continuing education\n\nrequirements be met prior to reinstatement.\n\nG. A dentist, dental assistant, or dental hygienist who is on\n\nactive duty with any of the Armed Forces of the United States and is\n\ndeployed outside of the United States shall be exempt from renewal\n\nfees.\n\nH. In case of a lost or destroyed license or renewal\n\ncertificate and upon satisfactory proof of the loss or destruction\n\nthereof, the Board may issue a duplicate, charging therefor a fee\nnt.\n\nG. A dentist, dental assistant, or dental hygienist who is on\n\nactive duty with any of the Armed Forces of the United States and is\n\ndeployed outside of the United States shall be exempt from renewal\n\nfees.\n\nH. In case of a lost or destroyed license or renewal\n\ncertificate and upon satisfactory proof of the loss or destruction\n\nthereof, the Board may issue a duplicate, charging therefor a fee\n\nestablished by the rules of the Board.\n\nI. A dentist, dental hygienist, or dental assistant that is in\n\ngood standing and not under investigation that notifies the Board in\n\nwriting of a voluntary nonrenewal of license or requests retirement\n\nstatus shall have a right to renew or reinstate his or her license\n\nwithin five (5) years from the date of notice. The Board may\n\nrequire any training or continuing education requirements to be met\n\nprior to reinstatement.\n\nJ. A dentist, dental hygienist, or dental assistant that has\n\nnot had an active license or permit in excess of five (5) years\n\nshall be required to apply as a new applicant.\n\nK.
