A holder of a license, a permit, or certificate granted by\n\nthe Board of Dentistry shall have the right to surrender the\n\nlicense, permit, or certificate, in writing, notarized, to the Board\n\nif the holder is in good standing with the Board as determined, in\n\nits discretion, by the Board. The Board shall accept such surrender\n\nin writing after approval at a regular or special Board meeting with\n\nthe statement that the holder is in good standing with the Board.\n\nAny holder who has surrendered a license, permit, or certificate\n\nissued by the Board and who shall apply for a license, permit, or\n\ncertificate after surrender shall be subject to all statutes and\n\nrules of the Board applicable at the time of the new application.\n\nB. A holder of a license, permit, or certificate shall not be\n\nconsidered to be in good standing if an investigation of a complaint\n\nis pending against the holder. The Board shall not accept a\n\nsurrender until a complaint is dismissed by the review panel, an\n\nagreed order or agreed order of surrender is entered, or the Board\n\ndetermines that an individual proceeding shall be initiated pursuant\n\nto Section 328.43a of this title.\n\nC. If a holder of a license, permit, or certificate wishes to\n\nsurrender the license, permit, or certificate during the pendency of\n\nan initial proceeding, the Board may accept or reject the surrender,\n\nin its discretion. The acceptance must be in writing after approval\n\nby the Board at a regular or special Board meeting. Any acceptance\n\nshall contain the statement that the acceptance is pending\n\ndisciplinary action. No person who surrenders a license, permit, or\n\ncertificate to the Board during a pending disciplinary action shall\n\nbe eligible for reinstatement for a period of five (5) years from\n\nthe date the surrender is accepted by the Board.\n\nD. The Board shall retain jurisdiction over the holder of any\n\nlicense, permit, or certificate for all disciplinary matters pending\n\nat the time surrender is sought by the holder or over any person\n\nthat does not renew his or her license while an investigation is\n\npending.\n\nE.
