All dentists in active practice licensed by the Board of\n\nDentistry shall maintain a policy for professional malpractice\n\nliability insurance; provided, however, that such requirement shall\n\nnot apply to dentists:\n\n1. Covered by a group or hospital malpractice insurance policy;\n\n2. Practicing in a state facility subject to The Governmental\n\nTort Claims Act, Section 151 et seq. of Title 51 of the Oklahoma\n\nStatutes;\n\n3. Practicing in a federal facility subject to the Federal Tort\n\nClaims Act;\n\n4. Providing care as a volunteer under a special volunteer\n\nlicense pursuant to Section 328.23a of this title;\n\n5. Providing care as a retired dentist with a valid license in\n\na volunteer, nonpaid capacity;\n\n6. Practicing or residing in another state or country, who will\n\nnot practice within this state during the license renewal year. A\n\ndentist that is residing but not practicing in this state but wishes\n\nto maintain an active license may sign an affidavit stating that the\n\ndentist is not practicing dentistry, listing the specific dates\n\nduring which the dentist will not practice. The dentist must notify\n\nthe Board in writing and provide proof of malpractice insurance no\n\nless than ten (10) days prior to resuming practice; or\n\n7. A dentist may petition the Board to be temporarily exempted\n\ndue to health, injury or other personal exigent circumstance during\n\nthe year. A signed and sworn affidavit and other documentation may\n\nbe required by the Board. The Board at its discretion may exempt a\n\ndentist for a specific stated period of time.\n\nB.
