Notwithstanding any other provision of law, the ability of a\n\npharmacy benefits manager (PBM) to initiate, continue, or conclude\n\nan audit of a pharmacy shall be tolled for the duration of a\n\ndeclared disaster and for an additional period of thirty (30)\n\ncalendar days following the termination of a declared disaster.\n\nSuch requirement shall apply only to the pharmacies located\n\nwithin the geographical boundaries of the county or counties\n\naffected by the declared disaster.\n\nB. The provisions of this section shall apply to all PBMs\n\noperating within this state, and to all audits conducted pursuant to\n\ncontracts between PBMs and pharmacies.\n\nC. This section shall not apply to:\n\n1. Audits conducted for suspected fraudulent activity if\n\ndocumented evidence of such activity exists; or\n\n2. Audits required to comply with federal or state law\n\nunrelated to the contractual relationship between a PBM and a\n\npharmacy.\n\nD. Nothing in this section shall be construed to prohibit a\n\npharmacy from voluntarily agreeing to continue or complete an audit\n\nduring the tolling period, provided such agreement is documented in\n\nwriting and signed by both parties.\n\nE. A PBM may submit a request to the Attorney General to\n\ncontinue or complete an audit during the tolling period, which the\n\nAttorney General may grant at his or her sole discretion.
