Stat. tit. 59, § 59-367.2","heading":"Definitions","body":"As used in the Utilization of Unused Prescription Medications\n\nAct:\n\n1. “Assisted living center” has the same meaning as such term\n\nis defined in Section 1-890.2 of Title 63 of the Oklahoma Statutes;\n\n2. “Cancer drugs” means any of several drugs that control or\n\nkill neoplastic cells, commonly referred to as “cancer-fighting\n\ndrugs”; and includes, but is not limited to, drugs used in\n\nchemotherapy to destroy cancer cells;\n\n3. “Health care professional” means any of the following\n\npersons licensed and authorized to prescribe and dispense drugs or\n\nto provide medical, dental, or other health-related diagnoses, care\n\nor treatment within the scope of their professional license:\n\na. a physician holding a current license to practice\n\nmedicine pursuant to Chapter 11 or Chapter 14 of Title\n\n59 of the Oklahoma Statutes,\n\nb. an advanced practice nurse licensed pursuant to\n\nChapter 12 of Title 59 of the Oklahoma Statutes,\n\nc. a physician assistant licensed pursuant to Chapter 11\n\nof Title 59 of the Oklahoma Statutes,\n\nd. a dentist licensed pursuant to Chapter 7 of Title 59\n\nof the Oklahoma Statutes,\n\ne. an optometrist licensed pursuant to Chapter 13 of\n\nTitle 59 of the Oklahoma Statutes, and\n\nf. a pharmacist licensed pursuant to Chapter 8 of Title\n\n59 of the Oklahoma Statutes;\n\n4. “Medically indigent” means a person eligible to receive\n\nMedicaid or Medicare or a person who has no health insurance and who\n\notherwise lacks reasonable means to purchase prescribed medications;\n\n5. “Charitable clinic” means a charitable nonprofit corporation\n\nor a facility organized as a not-for-profit pursuant to the\n\nprovisions of the Oklahoma General Corporation Act that:\n\na. holds a valid exemption from federal income taxation\n\nissued pursuant to Section 501(a) of the Internal\n\nRevenue Code (26 U.S.C., Section 501(a)),\n\nb. is listed as an exempt organization under 501(c) of\n\nthe Internal Revenue Code (26 U.S.C., Section 501(c)),\n\nc. provides on an outpatient basis for a period of less\n\nthan twenty-four (24) consecutive hours to persons not\n\nresiding or confined at such facility advice,\n\ncounseling, diagnosis, treatment, surgery, care or\n\nservices relating to the preservation or maintenance\n\nof health, and\n\nd. has a licensed outpatient pharmacy; and\n\n6. “Prescription drug” means a drug which may be dispensed only\n\nupon prescription by a health care professional authorized by his or\n\nher licensing authority and which is approved for safety and\n\neffectiveness as a prescription drug under Section 505 or 507 of the\n\nFederal Food, Drug and Cosmetic Act (52 Stat. 1040 (1938), 21\n\nU.S.C.A., Section 301).","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9521caf2082a1148174b0cbc504cacf0d65fc445e550179e59a3c3deb8b13db5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-367.1","next":"us-ok/okla.-stat.-tit.-59-59-367.3"},"notice":"GroundRules: Original legal text.
