Participation in the Utilization of Unused Prescription\n\nMedications Act by pharmacies, nursing homes, assisted living\n\ncenters, charitable clinics or prescription drug manufacturers shall\n\nbe voluntary. Nothing in the Utilization of Unused Prescription\n\nMedications Act shall require any pharmacy, nursing home, assisted\n\nliving center, charitable clinic or prescription drug manufacturer\n\nto participate in the program.\n\nB. A pharmacy or charitable clinic which meets the eligibility\n\nrequirements established in the Utilization of Unused Prescription\n\nMedications Act may:\n\n1. Dispense prescription drugs donated under the Utilization of\n\nUnused Prescription Medications Act to persons who are medically\n\nindigent residents of Oklahoma as established in rules by the Board\n\nof Pharmacy; and\n\n2. Charge persons receiving donated prescription drugs a\n\nhandling fee established by rule by the Board of Pharmacy.\n\nC. A pharmacy or charitable clinic which meets the eligibility\n\nrequirements established and authorized by the Utilization of Unused\n\nPrescription Medications Act which accepts donated prescription\n\ndrugs shall:\n\n1. Comply with all applicable federal and state laws related to\n\nthe storage and distribution of dangerous drugs;\n\n2. Inspect all prescription drugs prior to dispensing the\n\nprescription drugs to determine that such drugs are not adulterated;\n\nand\n\n3. Dispense prescription drugs only pursuant to a prescription\n\nissued by a health care professional.\n\nD. Prescription drugs donated under the Utilization of Unused\n\nPrescription Medications Act shall not be resold.\n\nE.
