Stat. tit. 59, § 59-367.5.1","heading":"Pharmacies operated by or under contract with","body":"Department of Corrections – Resale or redispensing of prescription\n\ndrugs.\n\nA. A pharmacy operated by the Department of Corrections or\n\nunder contract with the Department of Corrections or a county jail\n\nmay accept for the purpose of resale or redispensing a prescription\n\ndrug that has been dispensed and has left the control of the\n\npharmacist if the prescription drug is being returned by a state\n\ncorrectional facility or a county jail that has a licensed\n\nphysician's assistant, a registered professional nurse, or a\n\nlicensed practical nurse, who is responsible for the security,\n\nhandling, and administration of prescription drugs within that state\n\ncorrectional facility or county jail and if all of the following\n\nconditions are met:\n\n1. The pharmacist is satisfied that the conditions under which\n\nthe prescription drug has been delivered, stored and handled before\n\nand during its return were such as to prevent damage, deterioration\n\nor contamination that would adversely affect the identity, strength,\n\nquality, purity, stability, integrity or effectiveness of the\n\nprescription drug;\n\n2. The pharmacist is satisfied that the prescription drug did\n\nnot leave the control of the registered professional nurse or\n\nlicensed practical nurse responsible for the security, handling, and\n\nadministration of that prescription drug and that the prescription\n\ndrug did not come into the physical possession of the individual for\n\nwhom it was prescribed;\n\n3. The pharmacist is satisfied that the labeling and packaging\n\nof the prescription drug are accurate, have not been altered,\n\ndefaced or tampered with, and include the identity, strength,\n\nexpiration date and lot number of the prescription drug; and\n\n4. The prescription drug was dispensed in a unit dose package\n\nor unit of issue package.\n\nB. A pharmacy operated by the Department of Corrections or\n\nunder contract with the Department of Corrections or a county jail\n\nshall not accept or return prescription drugs as provided under this\n\nsection until the pharmacist in charge develops a written set of\n\nprotocols for accepting, returning to stock, repackaging, labeling\n\nand redispensing prescription drugs. The written protocols shall be\n\nmaintained on the premises and shall be readily accessible to each\n\npharmacist on duty and available for review by the Board. The\n\nwritten protocols shall include, but not be limited to:\n\n1. Methods to ensure that damage, deterioration or\n\ncontamination has not occurred during the delivery, handling,\n\nstorage and return of the prescription drugs which would adversely\n\naffect the identity, strength, quality, purity, stability, integrity\n\nor effectiveness of those prescription drugs or otherwise render\n\nthose drugs unfit for distribution;\n\n2. Methods for accepting, returning to stock, repackaging,\n\nlabeling and redispensing the prescription drugs returned pursuant\n\nto this section; and\n\n3. A uniform system of recording and tracking prescription\n\ndrugs that are returned to stock, repackaged, labeled, and\n\nredistributed pursuant to this section.\n\nC. If the integrity of a prescription drug and its package is\n\nmaintained, a prescription drug returned pursuant to this section\n\nshall be returned to stock and redistributed as follows:\n\n1. A prescription drug that was originally dispensed in the\n\nmanufacturer's unit dose package or unit of issue package and is\n\nreturned in that same package may be returned to stock, repackaged\n\nand redispensed as needed;\n\n2. A prescription drug that is repackaged into a unit dose\n\npackage or a unit of issue package by the pharmacy, dispensed and\n\nreturned to that pharmacy in that unit dose package or unit of issue\n\npackage may be returned to stock, but it shall not be repackaged. A\n\nunit dose package or unit of issue package prepared by the\n\npharmacist and returned to stock shall only be redispensed in that\needed;\n\n2. A prescription drug that is repackaged into a unit dose\n\npackage or a unit of issue package by the pharmacy, dispensed and\n\nreturned to that pharmacy in that unit dose package or unit of issue\n\npackage may be returned to stock, but it shall not be repackaged. A\n\nunit dose package or unit of issue package prepared by the\n\npharmacist and returned to stock shall only be redispensed in that\n\nsame unit dose package or unit of issue package. A pharmacist shall\n\nnot add unit dose package drugs to a partially used unit of issue\n\npackage.\n\nD. This section does not apply to any of the following:\n\n1. A controlled dangerous substance;\n\n2. A prescription drug that is dispensed as part of customized\n\nadherence medication packaging;\n\n3. A prescription drug that is not dispensed as a unit dose\n\npackage or a unit of issue package; or\n\n4.
