For matters related only to the lawful donation, acceptance,\n\nor dispensing of prescription drugs under the Utilization of Unused\n\nPrescription Medications Act, the following persons and entities, in\n\ncompliance with the Utilization of Unused Prescription Medications\n\nAct, in the absence of bad faith or gross negligence, shall not be\n\nsubject to criminal or civil liability for injury other than death,\n\nor loss to person or property, or professional disciplinary action:\n\n1. The Board of Pharmacy;\n\n2. The Department of Mental Health and Substance Abuse\n\nServices;\n\n3. Any prescription drug manufacturer, governmental entity,\n\nnursing home, or assisted living center donating prescription drugs\n\nunder the Utilization of Unused Prescription Medications Act;\n\n4. Any prescription drug manufacturer or its representative\n\nthat directly donates prescription drugs in professional samples to\n\na charitable clinic or a pharmacy under the Utilization of Unused\n\nPrescription Medications Act;\n\n5. Any pharmacy, charitable clinic or health care professional\n\nthat accepts or dispenses prescription drugs under the Utilization\n\nof Unused Prescription Medications Act; and\n\n6. Any pharmacy, charitable clinic, city-county pharmacy or\n\nother state-contracted pharmacy that employs a health care\n\nprofessional who accepts or can legally dispense prescription drugs\n\nunder the Utilization of Unused Prescription Medications Act and the\n\nOklahoma Pharmacy Act.\n\nB. For matters related to the donation, acceptance, or\n\ndispensing of a prescription drug manufactured by the prescription\n\ndrug manufacturer that is donated by any entity under the\n\nUtilization of Unused Prescription Medications Act, a prescription\n\ndrug manufacturer shall not, in the absence of bad faith or gross\n\nnegligence, be subject to criminal or civil liability for injury\n\nother than for death, or loss to person or property including, but\n\nnot limited to, liability for failure to transfer or communicate\n\nproduct or consumer information or the expiration date of the\n\ndonated prescription drug.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8f4fc5a32d48f872cda1b09067d6db2f33e244829570b4f037a5823d30049953","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-367.5.1","next":"us-ok/okla.-stat.-tit.-59-59-367.7"},"notice":"GroundRules: Original legal text.
