The Board of Pharmacy shall promulgate emergency rules by\n\nDecember 1, 2004, to implement the Utilization of Unused\n\nPrescription Medications Act. Permanent rules shall be promulgated\n\npursuant to the Administrative Procedures Act. Such rules shall\n\ninclude:\n\n1. Eligibility criteria for pharmacies and charitable clinics\n\nauthorized to receive and dispense donated prescription drugs under\n\nthe Utilization of Unused Prescription Medications Act;\n\n2. Establishment of a formulary which shall include all\n\nprescription drugs approved by the federal Food and Drug\n\nAdministration;\n\n3. Standards and procedures for transfer, acceptance, safe\n\nstorage, security, and dispensing of donated prescription drugs;\n\n4. A process for seeking input from the State Department of\n\nHealth in establishing provisions which affect nursing homes and\n\nassisted living centers;\n\n5. A process for seeking input from the Department of Mental\n\nHealth and Substance Abuse Services in establishing provisions which\n\naffect mental health and substance abuse clients;\n\n6. Standards and procedures for inspecting donated prescription\n\ndrugs to ensure that the drugs are in compliance with the\n\nUtilization of Unused Prescription Medications Act and to ensure\n\nthat, in the professional judgment of the pharmacist, the\n\nmedications meet all federal and state standards for product\n\nintegrity;\n\n7. Procedures for destruction of medications that are donated\n\nwhich are controlled substances;\n\n8. Procedures for verifying whether the pharmacy and\n\nresponsible pharmacist participating in the program are licensed and\n\nin good standing with the Board of Pharmacy;\n\n9. Establishment of standards for acceptance of unused\n\nprescription medications from assisted living centers; and\n\n10. Any other standards and procedures the Board of Pharmacy\n\ndeems appropriate or necessary to implement the provisions of the\n\nUtilization of Unused Prescription Medications Act.\n\nB. In accordance with the rules and procedures of the program\n\nestablished pursuant to this section, a resident of a nursing\n\nfacility or assisted living center, or the representative or\n\nguardian of a resident may donate unused prescription medications,\n\nother than prescription drugs defined as controlled dangerous\n\nsubstances by Section 2-101 of Title 63 of the Oklahoma Statutes,\n\nfor dispensation to medically indigent persons.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e1fa0d7d381b81ea850f4428baa433a57d12ee6239257a398873f735c43b06ed","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-367.6","next":"us-ok/okla.-stat.-tit.-59-59-367.8"},"notice":"GroundRules: Original legal text.
