This act shall be known and may be cited as the\n\n“Oklahoma Prescription Drug Discount Program Act of 2005”.\n\n2. Recognizing that many Oklahomans do not have health\n\ninsurance coverage for prescription drugs, the Oklahoma Legislature\n\nhereby establishes provisions to increase access to prescription\n\ndrugs for low income Oklahomans.\n\nB. The Oklahoma Health Care Authority shall contract with a\n\npharmacy benefit manager for the administration of a prescription\n\ndrug discount program. Oklahoma incorporated entities having a\n\nstrong working relationship with Oklahoma’s pharmacies should be\n\ngiven preference when selecting the administrating entity to ensure\n\nOklahoma pharmacy’s participation and to ensure the success of the\n\nprogram. The prescription drug discount program will:\n\n1. Enable persons without prescription drug coverage to be\n\nlinked to appropriate manufacturer-sponsored prescription drug\n\nprograms via the use of computer software;\n\n2. Establish agreements with prescription drug manufacturers\n\nthat outline available discounts and drugs, and in which\n\nprescription drug manufacturers agree to allow the Oklahoma Health\n\nCare Authority contracted pharmacy benefit manager to be the means\n\ntesting agent for their programs;\n\n3. Negotiate prescription drug discounts with manufacturers and\n\nutilize Medicaid reimbursement for pharmacy networks and implement a\n\n“one-stop” Oklahoma Prescription Drug Discount program for uninsured\n\nOklahomans and their families. All negotiated manufacturer drug\n\ndiscounts shall be provided as a one-hundred-percent pass-through\n\ndiscount to the plan participant. The plan administrator will be\n\nrequired to provide the Oklahoma Health Care Authority full\n\ndisclosure and transparency of financial relationships with\n\nmanufacturers for this program, and will include right-to-audit\n\nprovisions in all contracts with the Oklahoma Health Care Authority;\n\n4. Ensure that one hundred percent (100%) of the savings from\n\nprescription drug manufacturers and pharmacies is passed on to the\n\nconsumer;\n\n5. Enroll persons into a prescription drug discount card\n\nprogram using specialized computer software that will allow the\n\nconsumer to have access via a single application process to all\n\nparticipating prescription drug manufacturer discount programs;\n\n6. Include outreach and advertising of the program in order to\n\nprovide access to the program to potential consumers who do not have\n\naccess to prescription drug coverage; and\n\n7. Charge a basic enrollment fee to cover the administrative\n\ncosts of the program; provided, however, this provision shall not\n\napply to an applicant whose income is less than 150% of the Federal\n\nPoverty Level. Provided further, dispensing fees shall not exceed\n\nallowable Medicaid rates.\n\nC. Nothing in this act shall be construed to allow public\n\ndisclosure of any proprietary pricing information as contained in\n\ncontractual agreements between a pharmaceutical manufacturer and the\n\nOklahoma Health Care Authority, or a pharmacy benefit manager under\n\ncontract with the Oklahoma Health Care Authority to be the means\n\ntesting agent for the program.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7def4edb306f49e9015ee58f24816dd1d6026f111bd9f349c61592f730331ac9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-367.8","next":"us-ok/okla.-stat.-tit.-59-59-369"},"notice":"GroundRules: Original legal text.
