The State Board of Pharmacy may issue a license to an\n\napplicant for licensure as a supplier of durable medical equipment\n\nif the applicant pays the appropriate license fee established under\n\nSection 8 of this act and submits, in a form prescribed by the\n\nBoard, an application and proof that the applicant:\n\n1. a. Maintains a physical office or place of business\n\nwithin this state, or\n\nb. For a Medicare or Medicaid enrolled out-of-state\n\nsupplier, maintains a physical office or place of\n\nbusiness within one hundred (100) miles of a resident\n\nof this state being served by the supplier;\n\n2. Has obtained a state sales tax permit and any other\n\nnecessary license or permit as determined by the Board including but\n\nnot limited to any permit from the State Department of Health; and\n\n3. Meets all state and federal accreditation requirements.\n\nEach individual physical office or place of business owned or\n\noperated by the supplier must be licensed separately.\n\nB. 1. The Board may issue a license to a Medicare or Medicaid\n\nenrolled out-of-state supplier who has at least one accredited\n\nfacility within one hundred (100) miles of any resident of this\n\nstate being served by the supplier.\n\n2. The Board may assess a fee on out-of-state suppliers\n\nnecessary to cover the cost of inspection of those suppliers. The\n\ninspection fee shall be in addition to the licensure fee.\n\nC. A supplier licensed by the Board shall meet all safety\n\nstandards established by the Board, which shall include, but not be\n\nlimited to:\n\n1. Ensuring that all personnel engaged in delivery,\n\nmaintenance, and repair of durable medical equipment receive annual\n\ncontinuing education;\n\n2. Instructing the patient or patient's caregiver about how to\n\nuse the durable medical equipment provided;\n\n3. Receiving and responding to complaints from patients;\n\n4. Maintaining records of all patients receiving durable\n\nmedical equipment; and\n\n5. Managing, maintaining, and servicing durable medical\n\nequipment.\n\nD. The Board may revoke or suspend a license for:\n\n1. Violation of state or federal law;\n\n2. Violation of rules promulgated pursuant to the Oklahoma\n\nDurable Medical Equipment Licensing Act;\n\n3. Permitting, aiding, or abetting any illegal act;\n\n4. Failing to meet the safety standards established by the\n\nBoard pursuant to the Oklahoma Durable Medical Equipment Licensing\n\nAct;\n\n5. Engaging in conduct or practices found by the Board to be\n\ndetrimental to the health, safety, or welfare of patients; or\n\n6.
