Stat. tit. 59, § 59-396.30","heading":"Licenses – Requirements – Records and reports –","body":"Compliance with state and federal health and environmental laws –\n\nInspections.\n\nA. No person shall dispose of the body of any deceased person\n\nby cremation or other similar means, within this state, without\n\nfirst having obtained from the Oklahoma Funeral Board an annual\n\nlicense to operate a crematory.\n\nB. Application for an annual license shall be made to the\n\nexecutive director of the Board upon forms prescribed and furnished\n\nby the executive director, shall give the location of the crematory,\n\nand any other information as the executive director shall require,\n\nand shall be accompanied by the crematory license fee pursuant to\n\nSection 396.4 of this title. A crematory shall not be licensed\n\nseparately from a funeral or commercial embalming establishment but\n\nshall be licensed in conjunction with and operated by a funeral\n\nservice or commercial embalming establishment. Annual licenses\n\nshall expire on December 31 each year, shall specify the name or\n\nnames of the owners of the crematory and the location thereof, the\n\nfuneral director in charge, and shall not be transferable either as\n\nto the ownership of the crematory, the funeral director in charge or\n\nas to the location thereof. The first annual license issued for any\n\ncrematory at any location shall not be issued by the executive\n\ndirector until the executive director has been satisfied:\n\n1. That the crematory is, or will be, so constructed as to be\n\ncapable of reducing the body of a deceased person to a residue which\n\nshall not weigh more than five percent (5%) of the weight of the\n\nbody immediately after death; and\n\n2. That the crematory has at least one operable crematory for\n\ncremation.\n\nThe requirement of paragraph 1 of this subsection may, but need\n\nnot, be waived by the executive director for any subsequent annual\n\nlicense issued for the same crematory.\n\nC. All funeral establishments performing cremations shall have\n\na licensed funeral director in charge.\n\nD. Each funeral establishment performing cremation services\n\nshall keep records as required by the Board to assure compliance\n\nwith all laws relating to the disposition of dead human remains and\n\nshall file annually with the Board a report in the form prescribed\n\nby the Board describing the operations of the licensee, including\n\nthe number of cremations performed, the disposition thereof, and any\n\nother information that the Board may require by rule.\n\nE. A funeral establishment performing cremation services shall\n\nbe subject to all local, state, and federal health and environmental\n\nrequirements and shall obtain all necessary licenses and permits\n\nfrom the Oklahoma Funeral Board, and the appropriate federal and\n\nstate health and environmental authorities.\n\nF. Crematories licensed by the Board on the effective date of\n\nthis act shall be exempt from the provisions of subsections C, D and\n\nE of this section.\n\nG.
