The Oklahoma Funeral Board shall have the power to issue\n\nreciprocal licenses to applicants licensed in other states which\n\nhave equal or like educational requirements as required by this\n\nstate or the Board.\n\nB. A license as an embalmer or funeral director shall be issued\n\nwithout examination to an out-of-state resident intending to become\n\na resident of this state, who submits to the Board satisfactory\n\nevidence that said applicant has met all the requirements of the\n\nFuneral Services Licensing Act and pays the fees required by Section\n\n396.4 of this title.\n\nC. The Board may issue an appropriate license without further\n\napprenticeship to a resident of a state which does not have the same\n\neducational requirements necessary for reciprocity with this state,\n\nif said applicant:\n\n1. Has a current license to practice as an embalmer or funeral\n\ndirector in the state of residence of the person;\n\n2. Has been an active embalmer or funeral director practicing\n\nin the state of residence of the person for at least five (5) years;\n\n3. Has never been convicted of a felony crime that\n\nsubstantially relates to the occupation of an embalmer or funeral\n\ndirector and poses a reasonable threat to public safety, and has\n\nnever been convicted of a misdemeanor related to funeral service;\n\n4. Has never had said license revoked or suspended;\n\n5. Is not currently facing disciplinary action;\n\n6. Intends to practice in this state;\n\n7. Has filed such documents as are required by the Board;\n\n8. Has paid the fees as required by Section 396.4 of this\n\ntitle;\n\n9. Is a citizen or permanent resident of the United States;\n\n10. Is a graduate of an accredited program of mortuary science;\n\n11. Has passed the National Board Examination or State Board\n\nExamination administered by the International Conference of Funeral\n\nService Examining Board; and\n\n12. Has passed the Oklahoma State Law Examination.\n\nD. As used in this section:\n\n1. \"Substantially relates\" means the nature of criminal conduct\n\nfor which the person was convicted has a direct bearing on the\n\nfitness or ability to perform one or more of the duties or\n\nresponsibilities necessarily related to the occupation; and\n\n2. \"Poses a reasonable threat\" means the nature of criminal\n\nconduct for which the person was convicted involved an act or threat\n\nof harm against another and has a bearing on the fitness or ability\n\nto serve the public or work with others in the occupation.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2a3dcf1ac745f5e9607e65803b134a1da4092bc94b2b4813eb1c1f50a3f66c88","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-396.6","next":"us-ok/okla.-stat.-tit.-59-59-4000"},"notice":"GroundRules: Original legal text.
