All state entities that are charged with oversight of\n\noccupational licenses shall establish procedures by which\n\nindividuals who are convicted of a felony or misdemeanor where\n\nsubstance abuse or mental illness is the underlying cause of the\n\ncrime, or plead guilty or nolo contendere to a felony or misdemeanor\n\nwhere substance abuse or mental illness is the underlying cause of\n\nthe crime, may appeal to have an occupational license reinstated.\n\nB. All state entities described in this section may consider\n\nthe length of time since the plea or conviction. Other items that\n\nmay be considered are education since the plea or conviction,\n\nrecovery status since the plea or conviction if the underlying crime\n\nwas alcohol- or drug-related, and the public safety of allowing an\n\nindividual to return to the specific occupation.\n\nC.
