Any person or entity who has been determined by the Board to\n\nhave violated any provision of the State Architectural and Licensed\n\nInterior Designers Act or any rule or order issued pursuant to the\n\nprovisions of the State Architectural and Licensed Interior\n\nDesigners Act may be liable for a civil penalty of not more than One\n\nHundred Dollars ($100.00) for each day that said violation continues\n\nplus the legal costs incurred by the Board to prosecute the case.\n\nThe maximum civil penalty shall not exceed Ten Thousand Dollars\n\n($10,000.00) for any violation plus the legal costs incurred by the\n\nBoard to prosecute the case.\n\nB. The amount of the penalty shall be assessed by the Board\n\npursuant to the provisions of subsection A of this section, after\n\nnotice and hearing. In determining the amount of the penalty, the\n\nBoard shall include but not be limited to consideration of the\n\nnature, circumstances, and gravity of the violation and, with\n\nrespect to the person or entity found to have committed the\n\nviolation, the degree of culpability, the effect on ability of the\n\nperson or entity to continue to do business, and any show of good\n\nfaith in attempting to achieve compliance with the provisions of the\n\nState Architectural and Licensed Interior Designers Act. All monies\n\ncollected from such civil penalties shall be deposited with the\n\nState Treasurer of Oklahoma and placed in the Board of Architects'\n\nFund.\n\nC.
