An architect shall be required to plan, design and prepare\n\nplans and specifications for the following Code Use Groups except\n\nwhere specifically exempt from the provisions of the State\n\nArchitectural and Registered Commercial Interior Designers Act. All\n\nCode Use Groups in this section are defined by the current\n\nInternational Building Code.\n\nB. The construction, addition or alteration of a building of\n\nany size or occupancy in the following Code Use Groups shall be\n\nsubject to the provisions of the State Architectural and Registered\n\nCommercial Interior Designers Act:\n\n1. Code Use Group I - Institutional;\n\n2. Code Use Group R-2 - Residential, limited to dormitories,\n\nfraternities and sororities, and monasteries and convents;\n\n3. Code Use Group A-1 - Assembly and theaters;\n\n4. Code Use Group A-4 - Assembly, arenas and courts;\n\n5. Code Use Group A-5 - Assembly, bleachers and grandstands;\n\nand\n\n6. Buildings for which the designated Code Use Group changes\n\nare not exempt from the State Architectural and Registered\n\nCommercial Interior Designers Act.\n\nC. The following shall be exempt from the provisions of the\n\nState Architectural and Registered Commercial Interior Designers\n\nAct; provided that, for the purposes of this subsection, a basement\n\nis not to be counted as a story for the purpose of counting stories\n\nof a building for height regulations:\n\n1. The construction, addition or alteration of a building no\n\nmore than two stories in height and with a code-defined occupancy of\n\nno more than fifty (50) persons for the Code Use Groups A-2 and A-3\n\n- Assembly and Code Use Group E - Education;\n\n2. The construction, addition or alteration of a building no\n\nmore than two stories in height and no more than sixty-four\n\ntransient lodging units per building for the Code Use Group R1 -\n\nResidential, including, but not limited to, hotels and motels;\n\n3. The construction, addition or alteration of a building no\n\nmore than two stories in height and with a gross square footage not\n\nexceeding one hundred thousand (100,000) in the Code Use Group B -\n\nBusiness;\n\n4. The construction, addition or alteration of a building no\n\nmore than two stories in height and with a gross square footage not\n\nexceeding two hundred thousand (200,000) in the Code Use Group M -\n\nMercantile;\n\n5. The construction, addition or alteration of a building no\n\nmore than two stories in height in the following Code Use Groups or\n\nbuildings:\n\na. Code Use Group U - Utility,\n\nb. Code Use Group F - Factory and Industrial,\n\nc. Code Use Group H - High hazard,\n\nd. Code Use Group S - Storage,\n\ne. Code Use Group R2 - Residential, including apartments\n\ncontaining no more than thirty-two dwelling units or\n\nthirty-two guest units per building,\n\nf. Code Use Groups R3 and R4 - Residential,\n\ng. all buildings used by a municipality, county, state,\n\npublic trust, public agency or the federal government\n\nwith a construction value under One Hundred Fifty-\n\neight Thousand Dollars ($158,000.00),\n\nh. incidental buildings or appurtenances associated with\n\nparagraphs 1 through 5 of this subsection, and\n\ni. all uninhabitable, privately owned agricultural\n\nbuildings; and\n\n6. Single or two-family residential dwellings, as defined by\n\nthe International Residential Code adopted by the Oklahoma Uniform\n\nBuilding Code Commission.\n\nD. The addition, renovation or alteration of buildings where\n\nthe use was exempt as new construction shall remain exempt if the\n\nCode Use Group does not change.\n\nE. Upgrades, repairs, replacements and changes made on projects\n\nin Code Use Groups found in this title requiring an architect are\n\nexempt from hiring an architect if the upgrades, repairs,\n\nreplacements or changes do not affect the existing primary\n\nstructural, mechanical, or electrical systems, life-safety systems,\n\nfire codes or exit passageways and/or egress as determined by the\n\nbuilding official having jurisdiction.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2c433c666bc4c1a6a034d1ec7ebebaa6047703b1cc9233cc652d3a3873c29839","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-46.21b","next":"us-ok/okla.-stat.-tit.-59-59-46.21bv2"},"notice":"GroundRules: Original legal text.
