Stat. tit. 59, § 59-46.3v1","heading":"Definitions","body":"As used in the State Architectural and Registered Commercial\n\nInterior Designers Act:\n\n1. \"Architect\" means any person who is licensed in the practice\n\nof architecture in the State of Oklahoma as hereinafter defined;\n\n2. \"Practice of architecture\" means rendering or offering to\n\nrender certain services, in connection with the design and\n\nconstruction, enlargement or alteration of a building or a group of\n\nbuildings and the space surrounding such buildings, including\n\nbuildings which have as their principal purpose human occupancy or\n\nhabitation. The services referred to include planning, providing\n\npreliminary studies, designs, drawings, specifications,\n\ninvestigations or technical submissions, the administration of\n\nconstruction contracts, and the coordination of any elements of\n\ntechnical submissions prepared by other consultants including, as\n\nappropriate and without limitation, consulting engineers and\n\nlandscape architects; provided, that the practice of architecture\n\nshall include such other professional services as may be necessary\n\nfor the rendering of or offering to render architectural services.\n\nThe preparation of plans and specifications for the following\n\ntasks is within the scope of practice of both architecture and\n\nengineering:\n\na. site plans depicting the location and orientation of a\n\nbuilding on the site based on:\n\n(1) a determination of the relationship of the\n\nintended use with the environment, topography,\n\nvegetation, climate, and geographic aspects, and\n\n(2) the legal aspects of site development, including\n\nsetback requirements, zoning, and other legal\n\nrestrictions,\n\nb. life safety plans and related codes analyses,\n\nc. roof plans and details depicting the design of roof\n\nsystem materials, components, drainage, slopes, and\n\ndirections and location of roof accessories and\n\nequipment, not involving structural engineering\n\ncalculations,\n\nd. design of shallow spread footing foundations, and\n\ne. the incorporation of other design professionals'\n\ndepiction of building systems, including\n\narchitectural, structural, mechanical, electrical, and\n\nplumbing systems into the design professionals' own\n\nwork, in:\n\n(1) plan views,\n\n(2) cross-sections depicting building components from\n\na hypothetical cut line through buildings, and\n\n(3) the design of details of components and\n\nassemblies;\n\n3. \"Registration\" or \"license\" means a certificate of\n\nregistration or license issued by the Board. The definition of\n\n\"license\" shall apply to those persons licensed under a practice\n\nact. The definition of \"registration\" shall apply to those persons\n\nregistered under the title registered commercial interior designer\n\nunder this act;\n\n4. \"Building\" means any structure used, or intended to be used,\n\nto support, shelter, or enclose any use or occupancy;\n\n5. \"Board\" means the Board of Governors of the Licensed\n\nArchitects, Landscape Architects and Registered Commercial Interior\n\nDesigners of Oklahoma;\n\n6. \"Certificate of authority\" means the authorization granted\n\nby the Board for persons to practice or offer to practice\n\narchitecture, or landscape architecture, through a partnership,\n\ncorporation, limited liability company or limited liability\n\npartnership;\n\n7. \"Certificate of title\" means the authorization granted by\n\nthe Board for a partnership, corporation, limited liability company\n\nor limited liability partnership to use the title registered\n\ncommercial interior designer or any modification or derivation of\n\nthese terms;\n\n8. \"Technical submissions\" means drawings, plans,\n\nspecifications, studies and any other technical reports or documents\n\nwhich are issued in the course of practicing architecture, landscape\n\narchitecture or registered commercial interior design with the\n\nintent that they be considered as formal or final documents.\n\nTechnical submissions shall not include record drawings or\nvation of\n\nthese terms;\n\n8. \"Technical submissions\" means drawings, plans,\n\nspecifications, studies and any other technical reports or documents\n\nwhich are issued in the course of practicing architecture, landscape\n\narchitecture or registered commercial interior design with the\n\nintent that they be considered as formal or final documents.\n\nTechnical submissions shall not include record drawings or\n\nprototypical plans. However, technical submissions may be further\n\ndefined by Board rules;\n\n9. \"Responsible control\" means the active and personal\n\nmanagement by a licensed architect, landscape architect, or\n\nregistered commercial interior designer of the firm's personnel and\n\npractice, applying the required standard of care, to maintain\n\ndetailed knowledge over the design and technical decisions related\n\nto the preparation and implementation of the professional services\n\nto which the licensee or registrant affixes his or her seal,\n\nsignature, and date;\n\n10. \"Landscape architect\" means a person licensed to practice\n\nlandscape architecture as provided in the State Architectural and\n\nRegistered Commercial Interior Designers Act;\n\n11. \"Landscape architecture\" means the performance of\n\nprofessional services defined as teaching, consultations,\n\ninvestigations, reconnaissance, research, planning, design,\n\npreparation of construction drawings and specifications,\n\nconstruction observation and the coordination of any elements of\n\ntechnical submissions prepared by others in connection with the\n\nplanning and arranging of land and the elements thereon for public\n\nand private use and enjoyment, including the design and layout of\n\nroadways, service areas, parking areas, walkways, steps, ramps,\n\npools, parks, parkways, trails and recreational areas, the location\n\nand site of improvements including buildings and other structures,\n\nand the grading of the land, surface and subsoil drainage, erosion\n\ncontrol, planting, reforestation, and the preservation of the\n\nnatural landscape, in accordance with accepted professional\n\nstandards, and to the extent that the dominant purpose of such\n\nservices or creative works is the preservation, conservation,\n\nenhancement, or determination of proper land uses, natural land\n\nfeatures, ground cover and plantings, or naturalistic and aesthetic\n\nvalues.\n\nThe practice of landscape architecture shall include the\n\nlocation and arrangement of tangible objects and features as are\n\nincidental and necessary to the purpose outlined for landscape\n\narchitecture. The practice of landscape architecture shall not\n\ninclude the design of structures or facilities with separate and\n\nself-contained purposes for habitation or industry, or the design of\n\npublic streets, highways, utilities, storm and sanitary sewers and\n\nsewage treatment facilities, that are statutorily defined as the\n\npractice of engineering or architecture;\n\n12. \"Code\" means the nationally recognized codes adopted by the\n\nUniform Building Code Commission of the State of Oklahoma;\n\n13. \"Building official\" means the officer, other designated\n\nauthority, or duly authorized representative charged with the\n\nadministration and enforcement of the building code as implemented\n\nby the local, municipal or county jurisdiction in which a building\n\nis located. Where no building code has been adopted by the local,\n\nmunicipal or county jurisdiction, the building official shall be\n\ndefined as the State Fire Marshal;\n\n14. \"Registered commercial interior designer\" means a person\n\nrecognized by this state who is registered, qualified by examination\n\nand meeting all the requirements set forth in the State\n\nArchitectural and Registered Commercial Interior Designers Act and\n\nthe Board's rules;\n\n15. \"Plans\" means technical documents issued by the licensed\n\nand/or registered professionals intended to meet all current and\n\napplicable codes as adopted by the Uniform Building Code Commission\nby this state who is registered, qualified by examination\n\nand meeting all the requirements set forth in the State\n\nArchitectural and Registered Commercial Interior Designers Act and\n\nthe Board's rules;\n\n15. \"Plans\" means technical documents issued by the licensed\n\nand/or registered professionals intended to meet all current and\n\napplicable codes as adopted by the Uniform Building Code Commission\n\nof the State of Oklahoma, other statutory codes and applicable\n\nfederal codes and which shall be submitted to all required building\n\ncode and/or permit offices required by the State of Oklahoma,\n\ncounty, municipal and/or federal government;\n\n16. \"Equivalent standards\" means those standards adopted by the\n\nBoard intended to be used as alternative equivalents to determine\n\ncompetency for education, training and testing for licensing\n\narchitects and/or landscape architects and registering commercial\n\ninterior designers and for complying with the Military Service\n\nOccupation, Education and Credentialing Act for military personnel\n\nand their spouses;\n\n17. \"Commercial interior design\" means the rendering of or the\n\noffering to render designs, consultations, studies, planning,\n\ndrawings, specifications, contract documents or other technical\n\nsubmissions and the administration of interior construction and\n\ncontracts relating to nonstructural interior construction by a\n\nregistered commercial interior designer in a new constructed or\n\nexisting building when the core and shell elements are not going to\n\nbe changed;\n\n18. \"Nonstructural commercial interior construction\" means the\n\nconstruction of elements which do not include exterior components of\n\na building such as exterior walls, any load-bearing wall, any load-\n\nbearing column or any other load-bearing elements of a building\n\nessential to the structural integrity of the building such as wind\n\nloads and seismic loads and to any element which must be designed\n\nfor wind loads and seismic loads; and\n\nl9. \"Fire and life safety systems\" means those systems and\n\nconstruction that pertain to fire and life safety protection, such\n\nas fire sprinklers, fire alarms, smoke evacuation systems, fire\n\nwalls, fire barriers or smoke barriers as defined by the current\n\nInternational Building Code adopted by the Oklahoma Uniform Building\n\nCode Commission.\n\nThe definitions in the State Architectural and Registered\n\nCommercial Interior Designers Act shall have the same meaning when\n\napplicable to any rule promulgated pursuant to such act.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ee5cd133d27502a5fb8bd4de80b70311eea7052ea4c9c6652ffaa25aaac22fb2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-46.39","next":"us-ok/okla.-stat.-tit.-59-59-46.3v2"},"notice":"GroundRules: Original legal text.
