Stat. tit. 59, § 59-46.3v2","heading":"Definitions","body":"As used in the State Architectural and Licensed Interior\n\nDesigners Act:\n\n1. \"Architect\" means any person who is licensed in the practice\n\nof architecture in the State of Oklahoma as hereinafter defined;\n\n2. \"Practice of architecture\" means rendering or offering to\n\nrender certain services, in connection with the design and\n\nconstruction, enlargement or alteration of a building or a group of\n\nbuildings and the space surrounding such buildings, including\n\nbuildings which have as their principal purpose human occupancy or\n\nhabitation. The services referred to include planning, providing\n\npreliminary studies, designs, drawings, specifications,\n\ninvestigations and other technical submissions, the administration\n\nof construction contracts, and reviewing and coordinating technical\n\nsubmissions prepared by other licensed professionals for use in the\n\nconstruction or alteration of any building in the Code Use Groups\n\nsubject to the State Architectural and Licensed Interior Designers\n\nAct; provided, that the practice of architecture shall include such\n\nother professional services as may be necessary for the rendering of\n\nor offering to render architectural services;\n\n3. \"License\" means a license issued by the Board;\n\n4. \"Building\" means a structure consisting of a foundation,\n\nwalls, all floors and roof, with or without other parts;\n\n5. \"Board\" means the Board of Governors of the Architects,\n\nLandscape Architects and Licensed Interior Designers of Oklahoma;\n\n6. \"Certificate of authority\" means the authorization granted\n\nby the Board for persons to practice or offer to practice\n\narchitecture, landscape architecture, or licensed interior design\n\nthrough a partnership, firm, association, corporation, limited\n\nliability company or limited liability partnership;\n\n7. \"Technical submissions\" means drawings, plans,\n\nspecifications, studies and any other technical reports or documents\n\nwhich are issued in the course of practicing architecture, landscape\n\narchitecture or licensed interior design with the intent that they\n\nbe considered as formal or final documents, but shall not include\n\nrecord drawings. Prototypical plans are not technical submissions;\n\n8. \"Responsible control\" means the amount of direct control and\n\npersonal supervision of architectural, landscape architectural or\n\nlicensed interior design work and detailed knowledge of the content\n\nof tactical and technical submissions during their preparation as is\n\nordinarily exercised by architects, landscape architects or licensed\n\ninterior designers applying the required professional standard of\n\ncare. The terms direct control and personal supervision, whether\n\nused separately or together, mean active and personal management of\n\nthe firm's personnel and practice to maintain charge of, and\n\nconcurrent direction over, architecture, landscape architecture or\n\nlicensed interior design and the instruments of professional\n\nservices to which the licensee affixes the seal, signature, and\n\ndate;\n\n9. \"Landscape architect\" means a person licensed to practice\n\nlandscape architecture as provided in the State Architectural and\n\nLicensed Interior Designers Act;\n\n10. \"Landscape architecture\" means the performance of\n\nprofessional services defined as teaching, consultations,\n\ninvestigations, reconnaissance, research, planning, design,\n\npreparation of construction drawings and specifications,\n\nconstruction observation and the coordination of any elements of\n\ntechnical submissions prepared by others in connection with the\n\nplanning and arranging of land and the elements thereon for public\n\nand private use and enjoyment, including the design and layout of\n\nroadways, service areas, parking areas, walkways, steps, ramps,\n\npools, parks, parkways, trails and recreational areas, the location\n\nand site of improvements including buildings and other structures,\n\nand the grading of the land, surface and subsoil drainage, erosion\nnning and arranging of land and the elements thereon for public\n\nand private use and enjoyment, including the design and layout of\n\nroadways, service areas, parking areas, walkways, steps, ramps,\n\npools, parks, parkways, trails and recreational areas, the location\n\nand site of improvements including buildings and other structures,\n\nand the grading of the land, surface and subsoil drainage, erosion\n\ncontrol, planting, reforestation, and the preservation of the\n\nnatural landscape, in accordance with accepted professional\n\nstandards, and to the extent that the dominant purpose of such\n\nservices or creative works is the preservation, conservation,\n\nenhancement, or determination of proper land uses, natural land\n\nfeatures, ground cover and plantings, or naturalistic and aesthetic\n\nvalues.\n\nThe practice of landscape architecture shall include the\n\nlocation and arrangement of tangible objects and features as are\n\nincidental and necessary to the purpose outlined for landscape\n\narchitecture. The practice of landscape architecture shall not\n\ninclude the design of structures or facilities with separate and\n\nself-contained purposes for habitation or industry, or the design of\n\npublic streets, highways, utilities, storm and sanitary sewers and\n\nsewage treatment facilities, that are statutorily defined as the\n\npractice of engineering or architecture;\n\n11. \"Code\" means the nationally recognized codes adopted by the\n\nUniform Building Code Commission of the State of Oklahoma;\n\n12. \"Applicable building official\" means the official\n\nresponsible for the application of the adopted building code as\n\nimplemented by the local, municipal or county jurisdiction in which\n\na building is located. Where no building code has been adopted by\n\nthe local, municipal or county jurisdiction, the applicable building\n\nofficial shall be defined as the State Fire Marshal;\n\n13. \"Licensed interior designer\" means a person licensed to\n\npractice licensed interior design as provided in the State\n\nArchitectural and Licensed Interior Designers Act;\n\n14. \"Plans\" means technical documents issued by the licensed\n\nprofessionals intended to meet all current and applicable codes as\n\nadopted by the Uniform Building Code Commission of the State of\n\nOklahoma, other statutory codes and applicable federal codes and\n\nwhich shall be submitted to all required building code and/or permit\n\noffices required by the State of Oklahoma, county, municipal and/or\n\nfederal government;\n\n15. \"Equivalent standards\" means those standards adopted by the\n\nBoard intended to be used as alternative equivalents to determine\n\ncompetency for education, training and testing for architects,\n\nlandscape architects and licensed interior designers and for\n\ncomplying with the Military Service Occupation, Education and\n\nCredentialing Act for military personnel and their spouses;\n\n16. \"Licensed interior design\" means the rendering of or the\n\noffering to render services relating to nonstructural interior\n\nconstruction by a licensed interior designer in a newly constructed\n\nor existing building, including but not limited to:\n\na. analysis, research, planning, and design of the\n\ninterior spaces of a building for the purpose of\n\nenhancing and protecting the health, safety, and\n\nwelfare of the public by preparation of interior\n\ndrawings, specifications, or other technical\n\nsubmissions and administration of nonstructural\n\ninterior construction,\n\nb. design and specification of code-compliant interior\n\nfinishes, furnishings, fixtures, or equipment,\n\nc. design or modification of existing nonstructural\n\ninterior partitions, doors, suspended ceiling systems,\n\nor constructed ceiling elements,\n\nd. design or modification of existing internal\n\ncirculation systems or number and configuration of\n\ninterior exits for suite occupant load, or\n\ne. review, analysis, and evaluation of building codes,\ninterior\n\nfinishes, furnishings, fixtures, or equipment,\n\nc. design or modification of existing nonstructural\n\ninterior partitions, doors, suspended ceiling systems,\n\nor constructed ceiling elements,\n\nd. design or modification of existing internal\n\ncirculation systems or number and configuration of\n\ninterior exits for suite occupant load, or\n\ne. review, analysis, and evaluation of building codes,\n\naccessibility standards, or guidelines for interior\n\nplanning, design, and nonstructural interior\n\nconstruction compliance;\n\n17. \"Nonstructural interior construction\" means the\n\nconstruction of elements which do not include:\n\na. design of, or the responsibility for, architectural\n\nand engineering work, except as explicitly provided\n\nfor in this act,\n\nb. altering the building's existing primary structural,\n\nfire and life safety, mechanical, electrical, and\n\nplumbing systems, as set out in Oklahoma state law,\n\nthis act, or the current International Building Code\n\nas adopted by the Oklahoma Uniform Building Code\n\nCommission, or other related primary building systems,\n\nand\n\nc. changes to the building's core and shell; and\n\n18. \"Fire and life safety systems\" means those systems and\n\nconstruction that pertain to fire and life safety protection, such\n\nas fire sprinklers, fire alarms, smoke evacuation systems, fire\n\nwalls, fire barriers or smoke barriers as defined by the current\n\nInternational Building Code adopted by the Oklahoma Uniform Building\n\nCode Commission.\n\nThe definitions in the State Architectural and Licensed Interior\n\nDesigners Act shall have the same meaning when applicable to any\n\nrule promulgated pursuant to such act.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0efecc9d4399912603119b23eb97a3d1e8287e98afd3c5939d194731a9b3effd","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-46.3v1","next":"us-ok/okla.-stat.-tit.-59-59-46.4"},"notice":"GroundRules: Original legal text.
