Stat. tit. 59, § 59-475.18","heading":"Disciplinary actions - Grounds - Rules of Professional","body":"Conduct – Definitions.\n\nA. As provided in subsections A and B of Section 475.8 of this\n\ntitle, the Board shall have the power to deny, place on probation,\n\nsuspend, revoke, place practice restrictions on, or refuse to issue\n\na certificate or license, or fine, reprimand, issue orders, levy\n\nadministrative fines or seek other penalties, if a person or entity\n\nis found guilty of:\n\n1. Any fraud or deceit in obtaining or attempting to obtain or\n\nrenew a license, or a certificate of authority, or in taking the\n\nexaminations administered by the Board or its authorized\n\nrepresentatives;\n\n2. Any fraud, misrepresentation, gross negligence, gross\n\nincompetence, misconduct or dishonest practice, in the practice of\n\nengineering or surveying;\n\n3. Conviction of or entry of a plea of guilty or nolo\n\ncontendere to a felony crime that substantially relates to the\n\npractice of engineering or surveying and poses a reasonable threat\n\nto public safety; or conviction of or entry of a plea of guilty or\n\nnolo contendere to any crime, whether a felony, misdemeanor, or\n\notherwise, an essential element of which is dishonesty or is a\n\nviolation of the practice of engineering or surveying;\n\n4. Failure to comply with any of the provisions of this act or\n\nany of the rules or regulations pertaining thereto;\n\n5. Disciplinary action, including voluntary surrender of a\n\nprofessional engineer's or professional surveyor's license in order\n\nto avoid disciplinary action by another state, territory, the\n\nDistrict of Columbia, a foreign country, the United States\n\ngovernment, or any other governmental agency, if at least one of the\n\ngrounds for discipline is the same or substantially equivalent to\n\nthose contained in this section;\n\n6. Failure, within thirty (30) days, to provide information\n\nrequested by the Board or its designated staff as a result of a\n\nformal or informal investigation or complaint to the Board which\n\nwould indicate a violation of this act;\n\n7. Knowingly making false statements or signing false\n\nstatements, certificates or affidavits;\n\n8. Aiding or assisting another person or entity in violating\n\nany provision of this act or the rules or regulations pertaining\n\nthereto;\n\n9. Violation of any terms imposed by the Board, or using a seal\n\nor practicing professional engineering or professional surveying\n\nwhile the professional engineer's license or professional surveyor's\n\nlicense is restricted, suspended, revoked, nonrenewed, retired or\n\ninactive;\n\n10. Signing, affixing the professional engineer's or\n\nprofessional surveyor's seal, or permitting the professional\n\nengineer's or professional surveyor's seal or signature to be\n\naffixed to any specifications, reports, drawings, plans, design\n\ninformation, construction documents, calculations, other documents,\n\nor revisions thereof, which have not been prepared by, or under the\n\ndirect control and personal supervision of the professional engineer\n\nor professional surveyor in responsible charge;\n\n11. Engaging in dishonorable, unethical or unprofessional\n\nconduct of a character likely to deceive, defraud, harm or endanger\n\nthe public;\n\n12. Providing false testimony or information to the Board;\n\n13. Habitual intoxication or addiction to the use of alcohol or\n\nto the illegal use of a controlled dangerous substance;\n\n14. Performing engineering or surveying services outside any of\n\nthe licensee's areas of competence or an engineer's areas of\n\ncompetence designated in the official Board records;\n\n15. Violating the Oklahoma Minimum Standards for the Practice\n\nof Surveying; and\n\n16. Failing to obtain the required professional development\n\nhours, as approved by the Board, Board staff or Continuing Education\n\nCommittee as required by an audit.\n\nB. The Board shall prepare and adopt Rules of Professional\n\nConduct for Professional Engineers and Surveyors as provided for in\n\nSection 475.8 of this title. The Board may revise and amend these\ns for the Practice\n\nof Surveying; and\n\n16. Failing to obtain the required professional development\n\nhours, as approved by the Board, Board staff or Continuing Education\n\nCommittee as required by an audit.\n\nB. The Board shall prepare and adopt Rules of Professional\n\nConduct for Professional Engineers and Surveyors as provided for in\n\nSection 475.8 of this title. The Board may revise and amend these\n\nRules of Professional Conduct for Professional Engineers and\n\nSurveyors and shall notify each licensee, in writing, of such\n\nrevisions or amendments.\n\nC. Principals of a firm who do not obtain a certificate or\n\nauthorization for the firm as required by this act may be subject to\n\ndisciplinary action.\n\nD. As used in this section:\n\n1. \"Substantially relates\" means the nature of criminal conduct\n\nfor which the person was convicted has a direct bearing on the\n\nfitness or ability to perform one or more of the duties or\n\nresponsibilities necessarily related to the occupation; and\n\n2. \"Poses a reasonable threat\" means the nature of criminal\n\nconduct for which the person was convicted involved an act or threat\n\nof harm against another or has a bearing on the fitness or ability\n\nto serve the public or work with others in the occupation.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"cfa3a45c65c3247ac6ee6c6ebaf8891212a1095b54f18d3d3a99299076bbeb6e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-475.17","next":"us-ok/okla.-stat.-tit.-59-59-475.19"},"notice":"GroundRules: Original legal text.
