Stat. tit. 59, § 59-475.22","heading":"Exceptions","body":"This act shall not be construed to prevent:\n\n1. Other professions. The practice of any other legally\n\nrecognized profession;\n\n2. Temporary license:\n\na. Professional engineer. The practice or offer to\n\npractice engineering by a person not a resident of or\n\nhaving no established place of business in this state\n\nis allowed; provided, such person is legally qualified\n\nby licensure to practice engineering, as defined in\n\nSection 475.2 of this title, in the applicant's\n\nresident state or jurisdiction and who has made\n\napplication for licensure to the Board. Such person\n\nshall make application for temporary licensure to the\n\nBoard, in a manner prescribed by the Board. After\n\npayment of a temporary license fee, a temporary\n\nlicense may be granted to perform a particular job for\n\na definite period of time, to expire at the earliest\n\nissuance of a professional engineering license by the\n\nBoard. Further, such person shall submit a complete\n\npermanent professional engineer application to the\n\nBoard within thirty (30) days of the date of issuance\n\nof the temporary license, with all required properly\n\ncompleted forms and fees. Failure to submit a\n\npermanent professional engineer application for Board\n\nconsideration within the designated thirty-day time\n\nperiod may be considered a violation of this act and\n\nBoard rules. No right to practice engineering shall\n\naccrue to such applicant by reason of a temporary\n\nlicense for any works not set forth in the license,\n\nand\n\nb. Professional surveyor. The practice of surveying\n\nunder a temporary permit by a person licensed as a\n\nprofessional surveyor in another state is not\n\nconsidered to be in the best interest of the public\n\nand therefore shall not be granted unless the person\n\nis applying pursuant to the Military Service\n\nOccupation, Education and Credentialing Act;\n\n3. Employees and subordinates. The work of an employee or a\n\nsubordinate of a person holding a license under this act, or an\n\nemployee of a person practicing lawfully under paragraph 2 of this\n\nsection is allowed; provided, such work does not include final\n\nengineering or surveying designs or decisions and is done under the\n\ndirect supervision of and verified by a person holding a license\n\nunder this act or a person practicing lawfully under paragraph 2 of\n\nthis section;\n\n4. Material takeoff. Providing a list of material derived from\n\nmeasuring and interpreting a set of blueprints or plans, otherwise\n\nknown as a \"material takeoff\" or advising a person on such a\n\n\"material takeoff\" shall not constitute the practice of engineering;\n\nand\n\n5. A person shall not be construed to practice or offer to\n\npractice surveying, within the meaning and intent of this act, who\n\nmerely acts as an agent of a purchaser of surveying services.\n\nAgents of a purchaser of surveying services include, but are not\n\nlimited to, real estate agents and brokers, title companies,\n\nattorneys providing title examination services, and persons who or\n\nfirms that coordinate the acquisition and use of surveying services.\n\nThe coordination of surveying services includes, but is not limited\n\nto, sales and marketing of services, discussion of requirements of\n\nsurveys, contracting to furnish surveys, review of surveys, the\n\nrequesting of revisions of surveys, and making any and all\n\nmodifications to surveys with the written consent of the\n\nprofessional surveyor, and furnishing final revised copies to the\n\nprofessional surveyor showing all revisions, the distribution of\n\nsurveys and receiving payment for such services.
