The State Board of Licensure for Professional Engineers and\n\nSurveyors shall have the power to adopt and amend all bylaws and\n\nrules of procedure, not inconsistent with the Constitution and laws\n\nof this state and this act, including the adoption and promulgation\n\nof Rules of Professional Conduct for Professional Engineers and\n\nSurveyors, which may be reasonably necessary for the proper\n\nperformance of its duties and the regulation of its proceedings,\n\nmeetings, records, examinations and the conduct thereof. These\n\nactions by the Board shall be binding upon persons licensed or\n\nrecognized under this act and shall be applicable to firms which\n\nhold or should hold a certificate of authority, and non-licensees\n\nfound by the Board to be in violation of the provisions of this act.\n\nThe Board shall adopt and have an official seal, which shall be\n\naffixed to each certificate issued. The Board shall have the\n\nfurther power and authority to:\n\n1. Establish and amend minimum standards for the practice of\n\nengineering and surveying;\n\n2. Establish continuing education requirements for renewal of\n\nprofessional engineering and professional surveying licenses;\n\n3. Promulgate rules concerning the ethical marketing of\n\nprofessional engineering and professional surveying services; and\n\n4. Upon good cause shown, as hereinafter provided, deny the\n\nissuance, restoration or renewal of, or place on probation for a\n\nperiod of time and subject to such conditions as the Board may\n\nspecify, a license or certificate of authority. In addition, the\n\nBoard may suspend, revoke, place practice restrictions, or refuse to\n\nrenew licenses or certificates of authority previously issued, and\n\nupon proper showing to review, affirm, reverse, vacate or modify its\n\norders with respect to such denial, suspension, revocation or\n\nrefusal to renew.\n\nB. The Board is hereby authorized to levy administrative\n\npenalties against any person or entity who or which violates any of\n\nthe provisions of this act or any rule or regulation promulgated\n\npursuant thereto. The Board is hereby authorized to initiate\n\ndisciplinary, prosecutorial and injunctive proceedings against any\n\nperson or entity who or which has violated any of the provisions of\n\nthis act or any rule or regulation of the Board promulgated pursuant\n\nthereto. The Board shall investigate alleged violations of the\n\nprovisions of this act or of the rules or regulations, orders or\n\nfinal decisions of the Board.\n\nC. The Board is hereby authorized to acquire by purchase,\n\nlease, gift, solicitation of gift or by any other lawful means, and\n\nmaintain, use and operate real property and improvements; contract\n\nfor the maintenance, use, and operation of or lease of any and all\n\nreal property and improvements; lease or sublease any part of real\n\nproperty and improvements acquired pursuant to this section to\n\npublic entities, private entities, or private persons, on any terms\n\nand for any consideration deemed appropriate by the Board, subject\n\nto restrictions in purchase or lease documents relating to property\n\nacquired; provided, all contracts for real property and improvements\n\nshall be subject to the provisions of Section 63 of Title 74 of the\n\nOklahoma Statutes.\n\nD. In carrying into effect the provisions of this act, the\n\nBoard, under the hand of its Chair, Vice Chair, or Executive\n\nDirector and the seal of the Board, may subpoena witnesses and\n\ncompel their attendance, and may also require the submission of\n\nbooks, papers, documents or other pertinent data, in any\n\ndisciplinary matters, or in any case wherever a violation of this\n\nact is alleged. Upon failure or refusal to comply with any such\n\norder of the Board, or upon failure to honor its subpoena, as herein\n\nprovided, the Board may apply to a court of proper jurisdiction for\n\nan order to enforce compliance with same.\n\nE. The Board is hereby authorized in the name of the state to\npertinent data, in any\n\ndisciplinary matters, or in any case wherever a violation of this\n\nact is alleged. Upon failure or refusal to comply with any such\n\norder of the Board, or upon failure to honor its subpoena, as herein\n\nprovided, the Board may apply to a court of proper jurisdiction for\n\nan order to enforce compliance with same.\n\nE. The Board is hereby authorized in the name of the state to\n\napply for relief by injunction in the established manner provided in\n\ncases of civil procedure, without bond, to enforce the provisions of\n\nthis act, or to restrain any violation thereof. In such\n\nproceedings, it shall not be necessary to allege or prove either\n\nthat an adequate remedy at law does not exist or that substantial or\n\nirreparable damage would result from the continued violation\n\nthereof. The members of the Board shall not be personally liable\n\nunder this proceeding.\n\nF. The Board may subject an applicant for a license or a\n\nlicensee to such examinations as it deems necessary to determine the\n\napplicant's or licensee's qualifications. The Board may dispose of\n\na formal complaint against a licensee for a violation of this act by\n\nan order that a licensee shall complete the examinations as the\n\nBoard deems necessary to determine the qualifications of the\n\nlicensee, and upon the initial failure or refusal to successfully\n\ncomplete the examination, within the time ordered, place conditions\n\non the license of the licensee to practice and order other remedies\n\nuntil competence is demonstrated.\n\nG. No action or other legal proceedings for damages shall be\n\ninstituted against the Board or against any Board member or employee\n\nof the Board for any act done in good faith and in the intended\n\nperformance of any power granted under this act or for any neglect\n\nor default in the performance or exercise in good faith of any such\n\nduty or power.\n\nH. The Board may give scholarships, as determined by the Board,\n\nto an individual or individuals advancing toward obtaining an EAC,\n\nTAC/ABET, or Board-approved degree in engineering or surveying at an\n\nOklahoma higher education institution, and take such other action as\n\nmay be reasonably necessary or appropriate to effectuate the rules\n\nof the State Board of Licensure for Professional Engineers and\n\nSurveyors. The Board may, at its discretion, contract with other\n\nstate agencies and nonprofit corporations for the endowment,\n\nmanagement and administration of scholarships. The requirements of\n\nsuch scholarships shall be determined by the Board. However,\n\nnothing contained herein shall be construed as requiring the Board\n\nto endow or award any scholarship.\n\nI. The Board may use its funds to establish and conduct\n\ninstructional programs for persons who are currently licensed to\n\npractice engineering or surveying, as well as refresher courses for\n\npersons interested in obtaining adequate instruction or programs of\n\nstudy to qualify them for licensure to practice engineering or\n\nsurveying. The Board may expend its funds for these purposes and\n\nmay conduct, sponsor and arrange for instructional programs and also\n\nmay carry out instructional workforce development programs through\n\nextension courses or other media. The Board may enter into plans or\n\nagreements with community colleges, public or private institutions\n\nof higher learning, the State Board of Education, nonprofit\n\norganizations, or with Oklahoma CareerTech for the purpose of\n\nplanning, scheduling or arranging courses, instruction, extension\n\ncourses or in assisting in obtaining courses of study or programs in\n\nthe fields of engineering and surveying. The Board shall encourage\n\nthe educational institutions in Oklahoma to offer courses necessary\n\nto complete the educational requirements of this act. To carry out\n\nthese objectives, the Board may adopt rules as may be necessary for\n\nthe educational programs, instruction, extension services or for\nor in assisting in obtaining courses of study or programs in\n\nthe fields of engineering and surveying. The Board shall encourage\n\nthe educational institutions in Oklahoma to offer courses necessary\n\nto complete the educational requirements of this act.
