Unless otherwise prohibited by law, a valid physician-\n\npatient relationship may be established by an allopathic or\n\nosteopathic physician with a patient located in this state through\n\ntelemedicine, provided that the physician:\n\n1. Holds a license to practice medicine in this state;\n\n2. Confirms with the patient the patient's identity and\n\nphysical location; and\n\n3. Provides the patient with the treating physician's identity\n\nand professional credentials.\n\nB. Telemedicine encounters shall comply with the Health\n\nInsurance Portability and Accountability Act of 1996 and ensure that\n\nall patient communications and records are secure and confidential.\n\nC. Telemedicine encounters in this state shall not be used to\n\nestablish a valid physician-patient relationship for the purpose of\n\nprescribing opiates, synthetic opiates, semisynthetic opiates,\n\nbenzodiazepine or carisprodol, unless the encounter is used to\n\nprescribe:\n\n1. Opioid antagonists or partial agonists pursuant to Sections\n\n1-2506.1 and 1-2506.2 of Title 63 of the Oklahoma Statutes; or\n\n2. A Schedule III, IV, or V controlled dangerous substance\n\napproved by the United States Food and Drug Administration for\n\nmedication assisted treatment or detoxification treatment for\n\nsubstance use disorder.\n\nD. A physician-patient relationship shall not be created solely\n\nbased on the receipt of patient health information by a physician.\n\nThe duties and obligations created by a physician-patient\n\nrelationship shall not apply until the physician affirmatively:\n\n1. Undertakes to diagnose and treat the patient; or\n\n2.
