Stat. tit. 59, § 59-479.1","heading":"Supervising physician for Advanced Practice Registered","body":"Nurse — Requirements.\n\nA. As used in this section:\n\n1. “Advanced Practice Registered Nurse” has the same meaning as\n\ndefined in Section 567.3a of Title 59 of the Oklahoma Statutes,\n\nexcept that such term does not include a Certified Registered Nurse\n\nAnesthetist;\n\n2. “Board” means the State Board of Medical Licensure and\n\nSupervision or the State Board of Osteopathic Examiners, or both, as\n\nthe context indicates; and\n\n3. The terms “supervising physician” and “supervision” have the\n\nsame meaning as defined in Section 567.3a of Title 59 of the\n\nOklahoma Statutes.\n\nB. To be eligible to serve as a supervising physician for an\n\nAdvanced Practice Registered Nurse who has not obtained independent\n\nprescriptive authority under Section 1 of this act, the physician\n\nshall meet the following criteria:\n\n1. Have possession of a full and unrestricted license to\n\npractice allopathic or osteopathic medicine issued by the State\n\nBoard of Medical Licensure and Supervision or the State Board of\n\nOsteopathic Examiners;\n\n2. Have possession of a valid registration to prescribe\n\ncontrolled substances issued by the Drug Enforcement Administration\n\nand the Oklahoma State Bureau of Narcotics and Dangerous Drugs\n\nControl; and\n\n3. Be trained and fully qualified in the field of the Advanced\n\nPractice Registered Nurse’s specialty as determined by the\n\nphysician’s respective Board; provided, however, a supervising\n\nphysician for a Certified Nurse-Midwife may be a family practice\n\nphysician, obstetrician, or gynecologist.\n\nC. A supervising physician shall enter into a written\n\nsupervision agreement with each Advanced Practice Registered Nurse\n\nhe or she supervises. The supervising physician shall file the\n\nsupervision agreement with his or her respective Board in the manner\n\nprescribed by such Board. The supervision agreement shall specify:\n\n1. Any fees charged to the Advanced Practice Registered Nurse\n\nfor supervision services in accordance with subsection D of this\n\nsection;\n\n2. The scope of the Advanced Practice Registered Nurse’s\n\nprescriptive authority, subject to any limits on scope of\n\nprescriptive authority provided by the rules of the Oklahoma Board\n\nof Nursing;\n\n3. A description of the extent of the supervision required;\n\n4. The duties and responsibilities of the supervising\n\nphysician;\n\n5. Procedures for notice to be provided by the supervising\n\nphysician to Advanced Practice Registered Nurses for periods of\n\nabsence in accordance with subsection E of this section; and\n\n6. One or more alternate physicians designated to supervise the\n\nAdvanced Practice Registered Nurse in such periods of absence in\n\naccordance with the rules promulgated under subsection H of this\n\nsection.\n\nD. 1. A supervising physician may charge a reasonable fee to\n\nthe Advanced Practice Registered Nurse for his or her supervision\n\nservices. Any such fees shall be:\n\na. disclosed in the supervision agreement required under\n\nsubsection C of this section,\n\nb. appropriate based on the actual duties and\n\nresponsibilities of the supervising physician as\n\noutlined in the supervision agreement, and\n\nc. a fair market value hourly rate in accordance with the\n\nrules promulgated under subsection H of this section,\n\nor by mutual agreement between the Advanced Practice\n\nRegistered Nurse and supervising physician.\n\n2. The provisions of this subsection shall apply only to\n\ncompensation received by the supervising physician directly from the\n\nAdvanced Practice Registered Nurse. This subsection shall not be\n\nconstrued to:\n\na. preclude a supervising physician from entering into a\n\npayment arrangement for supervision fees to be paid by\n\nhis or her employer or health care entity in lieu of\n\nthe Advanced Practice Registered Nurse,\n\nb. preclude an employer or health care entity of a\n\nsupervising physician from prohibiting, limiting, or\n\notherwise addressing such supervision fees through\n\npolicies, contracts, or bylaws, or\n. preclude a supervising physician from entering into a\n\npayment arrangement for supervision fees to be paid by\n\nhis or her employer or health care entity in lieu of\n\nthe Advanced Practice Registered Nurse,\n\nb. preclude an employer or health care entity of a\n\nsupervising physician from prohibiting, limiting, or\n\notherwise addressing such supervision fees through\n\npolicies, contracts, or bylaws, or\n\nc. apply to or impact any compensation a supervising\n\nphysician receives from his or her employer or health\n\ncare entity for supervision services.\n\nE. A supervising physician shall notify all Advanced Practice\n\nRegistered Nurses under his or her supervision of reasonably\n\nanticipated periods of unavailability or incapacity on the part of\n\nthe supervising physician. Notice shall be given by the method\n\nagreed to by the supervising physician and the Advanced Practice\n\nRegistered Nurse within the written supervision agreement.\n\nF. The supervising physician shall report to his or her\n\nrespective Board, and shall notify all Advanced Practice Registered\n\nNurses under his or her supervision of, any changes to the\n\nsupervising relationship within thirty (30) calendar days including,\n\nbut not limited to, the addition or removal of an Advanced Practice\n\nRegistered Nurse under the physician’s supervision or a change to\n\nthe physician’s practice address or contact information. The\n\nphysician’s supervision agreements shall be amended as necessary to\n\nreflect any such changes.\n\nG. The State Board of Medical Licensure and Supervision and the\n\nState Board of Osteopathic Examiners shall not charge any fees to\n\nsupervising physicians or Advanced Practice Registered Nurses for\n\nthe maintenance or oversight of supervision agreements or other\n\nadministrative functions related to the implementation or\n\nenforcement of this section.\n\nH. The State Board of Medical Licensure and Supervision and the\n\nState Board of Osteopathic Examiners shall promulgate a uniform set\n\nof rules establishing standards for proper supervision of Advanced\n\nPractice Registered Nurses who have not obtained independent\n\nprescriptive authority under Section 1 of this act, including:\n\n1. The charging of reasonable fees to provide supervision\n\nservices. The rules shall establish a fair market value hourly rate\n\nfor such fees, which shall be redetermined biennially;\n\n2. Continuous availability of direct communications either in\n\nperson or by electronic communications between the Advanced Practice\n\nRegistered Nurse and supervising physician;\n\n3. Oversight and acceptance of responsibility for the ordering\n\nand transmission of written, telephonic, electronic, or oral\n\nprescriptions for drugs and other medical supplies, subject to the\n\nformulary established by the Oklahoma Board of Nursing;\n\n4. Review of prescribing patterns of the Advanced Practice\n\nRegistered Nurse;\n\n5. The delineation of a plan for emergencies; and\n\n6. The designation of one or more alternate physicians in the\n\nabsence of the supervising physician.\n\nI. A supervising physician may be subject to disciplinary\n\naction by his or her respective Board for failure to comply with the\n\nprovisions of, or the rules promulgated under, this section\n\nincluding, but not limited to, failure to provide proper\n\nsupervision.\n\nJ. If either Board imposes limits through rule on the number of\n\nAdvanced Practice Registered Nurses that a supervising physician may\n\nsupervise, such limits shall not apply when an Advanced Practice\n\nRegistered Nurse is practicing in a hospital licensed by the State\n\nDepartment of Health.\n\nK. The Executive Director of each Board shall report annually\n\nto the respective Board the number of complaints received in\n\nrelation to this section.\n\nL. The State Board of Medical Licensure and Supervision and the\n\nState Board of Osteopathic Examiners shall each create and maintain\nen an Advanced Practice\n\nRegistered Nurse is practicing in a hospital licensed by the State\n\nDepartment of Health.\n\nK. The Executive Director of each Board shall report annually\n\nto the respective Board the number of complaints received in\n\nrelation to this section.\n\nL.
