Every person before practicing medicine and surgery or\n\nany of the branches or departments of medicine and surgery, within\n\nthe meaning of the Oklahoma Allopathic Medical and Surgical\n\nLicensure and Supervision Act, the Oklahoma Osteopathic Medicine\n\nAct, or the Oklahoma Interventional Pain Management and Treatment\n\nAct, within this state, must be in legal possession of the unrevoked\n\nlicense or certificate issued pursuant to the Oklahoma Allopathic\n\nMedical and Surgical Licensure and Supervision Act or the Oklahoma\n\nOsteopathic Medicine Act.\n\n2. Any person practicing in such manner within this state, who\n\nis not in the legal possession of a license or certificate, shall,\n\nupon conviction, be guilty of a Class D1 felony offense, punishable\n\nby a fine in an amount not less than One Thousand Dollars\n\n($1,000.00) nor more than Ten Thousand Dollars ($10,000.00), or by\n\nimprisonment as provided for in subsections B through F of Section\n\n20N of Title 21 of the Oklahoma Statutes, or by both such fine and\n\nimprisonment.\n\n3. Each day a person is in violation of any provision of this\n\nsubsection shall constitute a separate criminal offense and, in\n\naddition, the district attorney may file a separate charge of\n\nmedical battery for each person who is injured as a result of\n\ntreatment or surgery performed in violation of this subsection.\n\n4. Any person who practices medicine and surgery or any of the\n\nbranches or departments thereof without first complying with the\n\nprovisions of the Oklahoma Allopathic Medical and Surgical Licensure\n\nand Supervision Act, the Oklahoma Osteopathic Medicine Act, or the\n\nOklahoma Interventional Pain Management and Treatment Act shall, in\n\naddition to the other penalties provided therein, receive no\n\ncompensation for such medical and surgical or branches or\n\ndepartments thereof services.\n\nB. 1. If a license has been revoked or suspended pursuant to\n\nthe Oklahoma Allopathic Medical and Surgical Licensure and\n\nSupervision Act or the Oklahoma Osteopathic Medicine Act whether for\n\ndisciplinary reasons or for failure to renew the license, the State\n\nBoard of Medical Licensure and Supervision may, subject to rules\n\npromulgated by the Board, assess and collect an administrative fine\n\nnot to exceed Five Thousand Dollars ($5,000.00) for each day after\n\nrevocation or suspension whether for disciplinary reasons or for\n\nfailure to renew such license that the person practices medicine and\n\nsurgery or any of the branches or departments thereof within this\n\nstate.\n\n2. The Board may impose administrative penalties against any\n\nperson who violates any of the provisions of the Oklahoma\n\nInterventional Pain Management and Treatment Act or any rule\n\npromulgated pursuant thereto. The Board is authorized to initiate\n\ndisciplinary and injunctive proceedings against any person who has\n\nviolated any of the provisions of the Oklahoma Interventional Pain\n\nManagement and Treatment Act or any rule of the Board promulgated\n\npursuant thereto. The Board is authorized in the name of the state\n\nto apply for relief by injunction in the established manner provided\n\nin cases of civil procedure, without bond, to enforce the provisions\n\nof the Oklahoma Interventional Pain Management and Treatment Act, or\n\nto restrain any violation thereof. The members of the Board shall\n\nnot be personally liable for proceeding under this section.\n\n3.
