Stat. tit. 59, § 59-492","heading":"Designation of physicians - Employment by hospitals -","body":"Practice of medicine defined - Services rendered by trained\n\nassistants - Persons practicing nonallopathic healing.\n\nA. Every person shall be regarded as practicing allopathic\n\nmedicine within the meaning and provisions of this act, who shall\n\nappend to his or her name the letters \"M.D.\", \"Physician\" or any\n\nother title, letters or designation which represent that such person\n\nis a physician, or who shall for a fee or any form of compensation\n\ndiagnose and/or treat disease, injury or deformity of persons in\n\nthis state by any allopathic legend drugs, surgery, manual, or\n\nmechanical treatment unless otherwise authorized by law.\n\nB. A hospital or related institution as such terms are defined\n\nin Section 1-701 of Title 63 of the Oklahoma Statutes, which has the\n\nprincipal purpose or function of providing hospital or medical care,\n\nincluding but not limited to any corporation, association, trust, or\n\nother organization organized and operated for such purpose, may\n\nemploy one or more persons who are duly licensed to practice\n\nmedicine in this state without being regarded as itself practicing\n\nmedicine within the meaning and provisions of this section. The\n\nemployment by the hospital or related institution of any person who\n\nis duly licensed to practice medicine in this state shall not, in\n\nand of itself, be considered as an act of unprofessional conduct by\n\nthe person so employed. Nothing provided herein shall eliminate,\n\nlimit, or restrict the liability for any act or failure to act of\n\nany hospital, any hospital's employees, or persons duly licensed to\n\npractice medicine.\n\nC. The definition of the practice of medicine and surgery shall\n\ninclude, but is not limited to:\n\n1. Advertising, holding out to the public, or representing in\n\nany manner that one is authorized to practice medicine and surgery\n\nin this state;\n\n2. Any offer or attempt to prescribe, order, give, or\n\nadminister any drug or medicine and surgery for the use of any other\n\nperson, except as otherwise authorized by law;\n\n3. a. any offer or attempt, except as otherwise authorized\n\nby law, to prevent, diagnose, correct, or treat in any\n\nmanner or by any means, methods, devises, or\n\ninstrumentalities except for manual manipulation any\n\ndisease, illness, pain, wound, fracture, infirmity,\n\ndefect, or abnormal physical or mental condition of\n\nany person, including the management of pregnancy and\n\nparturition, except as otherwise authorized by law,\n\nb. except as provided in subsection D of this section,\n\nperformance by a person within or outside of this\n\nstate, through an ongoing regular arrangement, of\n\ndiagnostic or treatment services, including but not\n\nlimited to, stroke prevention and treatment, through\n\nelectronic communications for any patient whose\n\ncondition is being diagnosed or treated within this\n\nstate by a physician duly licensed and practicing in\n\nthis state. A person who performs any of the\n\nfunctions covered by this subparagraph submits himself\n\nor herself to the jurisdiction of the courts of this\n\nstate for the purposes of any cause of action\n\nresulting from the functions performed, and\n\nc. nothing in the Oklahoma Allopathic Medical and\n\nSurgical Licensure and Supervision Act shall be\n\nconstrued to affect or give jurisdiction to the Board\n\nover any person other than medical doctors or persons\n\nholding themselves out as medical doctors;\n\n4. Any offer or attempt to perform any surgical operation upon\n\nany person, except as otherwise authorized by law; and\n\n5. The use of the title Doctor of Medicine, Physician, Surgeon,\n\nPhysician and Surgeon, Dr., M.D. or any combination thereof in the\n\nconduct of any occupation or profession pertaining to the\n\nprevention, diagnosis, or treatment of human disease or condition\n\nunless, where appropriate, such a designation additionally contains\nl operation upon\n\nany person, except as otherwise authorized by law; and\n\n5. The use of the title Doctor of Medicine, Physician, Surgeon,\n\nPhysician and Surgeon, Dr., M.D. or any combination thereof in the\n\nconduct of any occupation or profession pertaining to the\n\nprevention, diagnosis, or treatment of human disease or condition\n\nunless, where appropriate, such a designation additionally contains\n\nthe description of another branch of the healing arts for which one\n\nholds a valid license in this state.\n\nD. The practice of medicine and surgery, as defined in this\n\nsection, shall not include:\n\n1. A student while engaged in training in a medical school\n\napproved by the Board or while engaged in graduate medical training\n\nunder the supervision of the medical staff of a hospital or other\n\nhealth care facility approved by the state medical board for such\n\ntraining, except that a student engaged in graduate medical training\n\nshall hold a license issued by the Board for such training;\n\n2. Any person who provides medical treatment in cases of\n\nemergency where no fee or other consideration is contemplated,\n\ncharged or received;\n\n3. A commissioned medical officer of the armed forces of the\n\nUnited States or medical officer of the United States Public Health\n\nService or the Department of Veterans Affairs of the United States\n\nin the discharge of official duties and/or within federally\n\ncontrolled facilities; and provided that such person shall be fully\n\nlicensed to practice medicine and surgery in one or more\n\njurisdictions of the United States; provided further that such\n\nperson who holds a medical license in this state shall be subject to\n\nthe provisions of the Oklahoma Allopathic Medical and Surgical\n\nLicensure and Supervision Act;\n\n4. Any person licensed under any other act when properly\n\npracticing in the healing art for which that person is duly\n\nlicensed;\n\n5. The practice of those who endeavor to prevent or cure\n\ndisease or suffering by spiritual means or prayer;\n\n6. Any person administering a domestic or family remedy to a\n\nmember of such person's own family;\n\n7. Any person licensed to practice medicine and surgery in\n\nanother state or territory of the United States who renders\n\nemergency medical treatment or briefly provides critical medical\n\nservice at the specific lawful direction of a medical institution or\n\nfederal agency that assumes full responsibility for that treatment\n\nor service and is approved by the Board;\n\n8. Any person who is licensed to practice medicine and surgery\n\nin another state or territory of the United States whose sole\n\npurpose and activity is limited to brief actual consultation with a\n\nspecific physician who is licensed to practice medicine and surgery\n\nby the Board, other than a person with a special or restricted\n\nlicense; or\n\n9. The practice of any other person as licensed by appropriate\n\nagencies of this state, provided that such duties are consistent\n\nwith the accepted standards of the person's profession and the\n\nperson does not represent himself or herself as a Doctor of\n\nMedicine, Physician, Surgeon, Physician and Surgeon, Dr., M.D., or\n\nany combination thereof.\n\nE. Nothing in the Oklahoma Allopathic Medical and Surgical\n\nLicensure and Supervision Act shall prohibit:\n\n1. The service rendered by a physician's unlicensed trained\n\nassistant, if such service is rendered under the supervision and\n\ncontrol of a licensed physician pursuant to Board rules, provided\n\nsuch rules are not in conflict with the provisions of any other\n\nhealing arts licensure act or rules promulgated pursuant to such\n\nact; or\n\n2. The service of any other person duly licensed or certified\n\nby the state to practice the healing arts.\n\nF. Nothing in the Oklahoma Allopathic Medical and Surgical\n\nLicensure and Supervision Act shall prohibit services rendered by\n\nany person not licensed by the Board and practicing any\n\nnonallopathic healing practice.\nr\n\nhealing arts licensure act or rules promulgated pursuant to such\n\nact; or\n\n2. The service of any other person duly licensed or certified\n\nby the state to practice the healing arts.\n\nF. Nothing in the Oklahoma Allopathic Medical and Surgical\n\nLicensure and Supervision Act shall prohibit services rendered by\n\nany person not licensed by the Board and practicing any\n\nnonallopathic healing practice.\n\nG. Nothing in the Oklahoma Allopathic Medical and Surgical\n\nLicensure and Supervision Act shall be construed as to require a\n\nphysician to secure a Maintenance of Certification (MOC) as a\n\ncondition of licensure, reimbursement, employment or admitting\n\nprivileges at a hospital in this state.
