Stat. tit. 59, § 59-504","heading":"Process - How served - Depositions - Subpoenas","body":"All citations and subpoenas, under the contemplation of this\n\nact, shall be served in general accordance with the statutes of the\n\nState of Oklahoma then in force applying to the service of such\n\ndocuments, and all provisions of the statutes of the state then in\n\nforce, relating to citations and subpoenas, are hereby made\n\napplicable to the citations and subpoenas herein provided for. The\n\nsecretary of the State Board of Medical Licensure and Supervision,\n\nor the secretary's designee, during the course of an investigation,\n\nshall have the power to issue subpoenas for the attendance of\n\nwitnesses, the inspection of premises and the production of\n\ndocuments or things, including, but not limited to, pharmacy,\n\nmedical and hospital records. Such subpoenas shall carry the same\n\nforce and effect as if issued as an order from a district court of\n\ncompetent jurisdiction. Patient confidentiality shall be maintained\n\nby the Board and subpoena compliance shall not be considered a\n\nviolation of any state or federal confidentiality laws. All the\n\nprovisions of the statutes of the state, then in force, governing\n\nthe taking of testimony by depositions, are made applicable to the\n\ntaking of depositions under this act. The attendance of witnesses\n\nshall be compelled in such hearings by subpoenas issued by the\n\nsecretary of the Board over the seal thereof, and the secretary\n\nshall in no case refuse to issue such subpoenas upon praecipe filed\n\ntherefor accompanied with the fee of Five Dollars ($5.00) for each\n\nsubpoena issued. If any person refuse to obey such subpoena served\n\nupon him in such manner, the fact of such refusal shall be certified\n\nby the secretary of the Board, over the seal thereof, to the\n\ndistrict court of the county in which such service was had, and the\n\ncourt shall proceed to hear said matter in accordance with the\n\nstatutes of the state then in force governing contempt as for\n\ndisobedience of its own process.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ae898bcc492cf86256c946ac7b9187f121cc54c3a9ecd021b230fac9b494be99","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-503.2","next":"us-ok/okla.-stat.-tit.-59-59-505"},"notice":"GroundRules: Original legal text.
