No person shall practice or hold himself or herself out as\n\nbeing able to practice therapeutic recreation or provide therapeutic\n\nrecreation services in this state unless the person is licensed in\n\naccordance with the provisions of the Therapeutic Recreation\n\nPractice Act.\n\nB. Nothing in this act shall be construed to prevent or\n\nrestrict the practice, services, or activities of:\n\n1. Any person of other licensed professions or personnel\n\nsupervised by licensed professions in this state from performing\n\nwork incidental to the practice of his or her profession or\n\noccupation, if that person does not represent himself or herself as\n\na therapeutic recreation specialist;\n\n2. Any person enrolled in a course of study leading to a degree\n\nor certificate in therapeutic recreation from performing therapeutic\n\nrecreation services incidental to the person's course work when\n\nsupervised by a licensed professional, if the person is designated\n\nby a title which clearly indicates his or her status as a student;\n\n3. Any person whose training and national certification attests\n\nto the individual’s preparation and ability to practice his or her\n\nprofession, if that person does not represent himself or herself as\n\na therapeutic recreation specialist;\n\n4. Any therapeutic recreation assistant providing therapeutic\n\nrecreation services under the direct supervision of a licensed\n\ntherapeutic recreation specialist. Such an individual would not be\n\npermitted to conduct assessments and/or develop treatment plans;\n\n5. Any individual providing recreational programs to a person\n\nwith disabilities as a normal part of the leisure lifestyle of the\n\nperson with disabilities;\n\n6. Any person employed by an agency, bureau or division of the\n\nfederal government while in the discharge of official duties;\n\nprovided, however, if such individual engages in the practice of\n\ntherapeutic recreation outside the line of official duty, the\n\nindividual must be licensed as herein provided;\n\n7. Any occupational therapist or occupational therapy\n\nassistants in the area of play and leisure; and\n\n8.
