The Oklahoma Board of Nursing is hereby established in the\n\nState of Oklahoma. The Board shall consist of eleven (11) members\n\nwho shall be citizens of the United States of America, and residents\n\nof Oklahoma, for at least the previous three (3) years. Six of the\n\nmembers shall be Registered Nurses, in good standing under the\n\nprovisions of the Oklahoma Nursing Practice Act, currently engaged\n\nin the practice of nursing as a Registered Nurse and shall have had\n\nno less than five (5) years of experience as a Registered Nurse. At\n\nleast two of the Registered Nurses shall be from the field of\n\nnursing education, actively associated with a recognized school of\n\nnursing in Oklahoma, and who hold an organizational role of\n\nadministration/management and who are accountable for strategic,\n\noperational and/or performance outcomes. At least two of the\n\nRegistered Nurses who hold an organizational role of\n\nadministration/management and who are accountable for strategic,\n\noperational and/or performance outcomes shall represent nursing\n\nservice. At least one of the Registered Nurses shall be currently\n\nengaged in the practice of nursing as an Advanced Practice\n\nRegistered Nurse. Three of the members shall be Licensed Practical\n\nNurses in good standing under the provisions of the Oklahoma Nursing\n\nPractice Act and currently engaged in the practice of practical\n\nnursing as a Licensed Practical Nurse and shall have had no less\n\nthan five (5) years of experience as a Licensed Practical Nurse.\n\nOne of the licensed nurses must be employed in the field of long-\n\nterm care. One of the licensed nurses shall be employed in the area\n\nof acute care. Two members shall represent the public and shall be\n\neligible voters of this state, knowledgeable in consumer health\n\nconcerns, and shall neither be nor ever have been associated with\n\nthe provision of health care, nor be enrolled in any health-related\n\neducational program. The public members shall be appointed by the\n\nGovernor to serve coterminously with the Governor. At least one\n\nRegistered Nurse Board member, one Licensed Practical Nurse Board\n\nmember and one public Board member shall be appointed from a county\n\nwith a population of less than forty thousand (40,000).\n\nB. For the purpose of nominating, appointing or reappointing\n\nmembers to the Board, this state shall be divided into eight\n\ngeographical districts, consisting of counties within the districts\n\nas follows:\n\nDistrict No. 1 Cimarron, Texas, Beaver, Harper, Woods, Alfalfa,\n\nGrant, Kay, Ellis, Woodward, Major, Garfield,\n\nNoble, Dewey, Blaine, Kingfisher and Logan;\n\nDistrict No. 2 Roger Mills, Custer, Beckham, Washita, Caddo,\n\nGreer, Kiowa, Harmon, Jackson, Comanche, Tillman\n\nand Cotton;\n\nDistrict No. 3 Canadian, Grady, McClain, Garvin, Stephens,\n\nMurray, Jefferson, Carter and Love;\n\nDistrict No. 4 Oklahoma;\n\nDistrict No. 5 Lincoln, Okfuskee, Cleveland, Pottawatomie,\n\nSeminole, Hughes, Pontotoc, Coal, Johnston,\n\nMarshall and Bryan;\n\nDistrict No. 6 Creek and Tulsa;\n\nDistrict No. 7 Osage, Washington, Nowata, Craig, Ottawa,\n\nPawnee, Payne, Rogers, Mayes and Delaware; and\n\nDistrict No. 8 Wagoner, Cherokee, Adair, Okmulgee, Muskogee,\n\nSequoyah, McIntosh, Haskell, Leflore, Pittsburg,\n\nLatimer, Atoka, Pushmataha, McCurtain and\n\nChoctaw.\n\nNot more than one Registered Nurse and one Licensed Practical\n\nNurse and one public member shall be appointed from any one\n\ngeographical district.\n\nC. The Governor shall appoint the Registered Nurse Board\n\nmembers from a list of names submitted by the Oklahoma Nurses\n\nAssociation and Oklahoma chapters of nationally recognized\n\nRegistered Nurse organizations. The Governor shall appoint the\n\nLicensed Practical Nurse Board members from a list of names\n\nsubmitted by the Oklahoma chapters of nationally recognized nursing\n\norganizations. Individuals who are members of the Oklahoma Board of\ned Nurse Board\n\nmembers from a list of names submitted by the Oklahoma Nurses\n\nAssociation and Oklahoma chapters of nationally recognized\n\nRegistered Nurse organizations. The Governor shall appoint the\n\nLicensed Practical Nurse Board members from a list of names\n\nsubmitted by the Oklahoma chapters of nationally recognized nursing\n\norganizations. Individuals who are members of the Oklahoma Board of\n\nNursing prior to September 1, 1991, shall be allowed to fulfill\n\ntheir terms and be eligible for reappointment.\n\nD. The Registered Nurse and Licensed Practical Nurse members\n\nshall be appointed for terms of five (5) years. Upon the death,\n\nresignation, or removal of any member, a list from the\n\naforementioned organizations shall be submitted to the Governor who\n\nshall appoint a member to fill the vacancy.\n\n1. In addition to the grounds for removal by the Governor of\n\nmembers appointed to the Board provided in Section 2 of Title 74 of\n\nthe Oklahoma Statutes, it is a ground for removal if a member:\n\na. does not have at the time of appointment the\n\nqualifications required by subsection A of this\n\nsection,\n\nb. is not employed in nursing for a period of twelve (12)\n\nconsecutive months during the term for which the\n\nmember was appointed,\n\nc. is absent from more than half of the regularly\n\nscheduled Board meetings that the member is eligible\n\nto attend during a calendar year, unless the absence\n\nis excused by a majority vote of the Board, or\n\nd. cannot discharge the duties as a Board member for a\n\nsubstantial portion of the term for which the member\n\nis appointed because of illness or disability.\n\n2. The validity of an action of the Board is not affected by\n\nthe fact that it is taken when a ground for removal of a Board\n\nmember exists.\n\n3. If the president of the Board has knowledge that a potential\n\nground for removal exists, the president shall then notify the\n\nGovernor that a potential ground for removal exists.\n\nE. A quorum shall be a majority of the Board which must include\n\nat least three Registered Nurses and one Licensed Practical Nurse.\n\nF. The members of the Board shall annually elect from their\n\nnumber a president, vice-president and a secretary who shall also be\n\nthe treasurer, and other such officers as necessary to conduct the\n\nbusiness of the Board. It shall hold six regular business meetings\n\nduring each calendar year. Special meetings may be called by the\n\npresident or secretary with five (5) days' notice to each member of\n\nthe Board. The Board shall have a seal; it shall make and adopt all\n\nnecessary rules not inconsistent with the laws of this state, the\n\nUnited States, or with the Oklahoma Nursing Practice Act; and it\n\nshall perform the duties and transact the business required under\n\nthe provisions of the act. The Board shall cause to be kept a\n\nrecord of all meetings of the Board and give notice of all meetings\n\nin accordance with the Administrative Procedures Act and the Open\n\nMeeting Act. A list of all persons duly licensed and qualified\n\nunder this act shall be maintained by the Board. Each member of the\n\nBoard shall receive, in addition to actual and necessary travel\n\nexpenses as provided in the State Travel Reimbursement Act,\n\ncompensation of One Hundred Dollars ($100.00) for each regular\n\nscheduled monthly meeting attended, not to exceed more than six\n\nmeetings per year. All monies received by the Board shall be held\n\nby the treasurer of the Board for meeting the expenses of the Board\n\nand for the promotion of nursing education, to employ an attorney to\n\nassist the Board and other state and county officials in carrying\n\nout the provisions of the Oklahoma Nursing Practice Act, and such\n\nother purposes which the Board may determine, and shall be disbursed\n\nas directed by the Board. The Board is authorized to adopt and\ne treasurer of the Board for meeting the expenses of the Board\n\nand for the promotion of nursing education, to employ an attorney to\n\nassist the Board and other state and county officials in carrying\n\nout the provisions of the Oklahoma Nursing Practice Act, and such\n\nother purposes which the Board may determine, and shall be disbursed\n\nas directed by the Board. The Board is authorized to adopt and\n\nrevise rules, not inconsistent with the provisions of the Oklahoma\n\nNursing Practice Act, as may be necessary to enable it to carry into\n\neffect the provisions of the act, including rules establishing fees,\n\ncharges and reimbursement costs. The Board shall appoint and employ\n\na qualified person, who shall be a Registered Nurse to serve as\n\nExecutive Director, and shall fix the compensation, notwithstanding\n\nany other provision of law including Section 3601.2 of Title 74 of\n\nthe Oklahoma Statutes, in an amount not in excess of the maximum\n\nsalary proposed for the Oklahoma Board of Nursing and set forth in\n\nthe most recent Compensation Report prepared by or for the Office of\n\nManagement and Enterprise Services, require a satisfactory bond, and\n\ndefine the duties of the Executive Director to include:\n\n1. The authority and responsibility for the operations and\n\nadministration of the agency and such additional powers and duties\n\nas prescribed by the Board. As chief executive of the Board, the\n\nExecutive Director shall manage all aspects of the agency, including\n\npersonnel, financial and other resources, in support of the Oklahoma\n\nNursing Practice Act, its rules and policies, and the Board's\n\nmission and strategic plan;\n\n2. The authority to accept orders as set forth in paragraph 3\n\nof this subsection on behalf of the Board and where ratification by\n\nthe Board is not required. The Executive Director shall report\n\nsummaries of dispositions to the Board at its regular meetings;\n\n3. a. Orders issued under Section 2 of this act,\n\nb. Agreed disciplinary orders requiring an applicant or\n\nlicensee to enter and comply with the Peer Assistance\n\nProgram,\n\nc. Agreed disciplinary orders for the reinstatement or\n\nendorsement of a license/certificate/recognition when\n\nthe applicant has practiced without an active Oklahoma\n\nlicense/certificate/recognition, and\n\nd.
