Stat. tit. 59, § 59-588","heading":"Practice by unauthorized person - Impersonating","body":"optometrist - Evidence of violations - Criminal and civil penalties\n\n- Students and instructors.\n\nA. No person shall practice optometry in this state or make any\n\ntests or measurements of the human eye for diagnostic purposes\n\nunless said person has been issued a certificate pursuant to the\n\nprovisions of Section 584 of this title or is a physician or surgeon\n\nauthorized to practice medicine in this state. No person shall\n\nimpersonate a registered optometrist. No person shall buy, sell or\n\nobtain in any manner a certificate of registration or exemption\n\nissued to another. Practicing or offering to practice optometry, or\n\nthe public representation of being qualified to practice optometry,\n\nby any person not authorized to practice optometry shall be\n\nsufficient evidence of the violation of the provisions of Sections\n\n581 through 604 of this title. No optometrist shall aid or abet any\n\nperson not authorized to practice optometry in this state to\n\npractice optometry. Any person who violates any of the provisions\n\nof Sections 581 through 604 of this title shall be deemed guilty of\n\na misdemeanor, and upon conviction for each offense, shall be\n\npunished by a fine of not less than Fifty Dollars ($50.00), nor more\n\nthan Five Hundred Dollars ($500.00), or imprisonment in the county\n\njail not less than thirty (30) days, nor more than ninety (90) days,\n\nor by both fine and imprisonment.\n\nB. In addition to the criminal penalties prescribed above, any\n\nnatural person, partnership, or business entity, found by a\n\npreponderance of the evidence to have practiced optometry within the\n\nState of Oklahoma without a currently valid license or certificate\n\nissued by the Board, or to have dispensed, supplied, fitted,\n\nadjusted, adapted, or in any manner applied contact lenses to the\n\neyes of a person whether or not those contact lenses are designed to\n\naid or correct human vision or have no prescription power or are\n\ncosmetic contact lenses, without a full contact lens prescription\n\nissued by a person licensed pursuant to Chapter 11, Chapter 13 or\n\nChapter 14 of this title, shall, after notice and an opportunity to\n\nbe heard pursuant to the Board's rules and Article II of the\n\nAdministrative Procedures Act, be liable for a civil administrative\n\npenalty of at least One Hundred Dollars ($100.00) but not more than\n\nTwo Thousand Five Hundred Dollars ($2,500.00) for each instance of\n\nunlicensed practice of optometry. This provision shall not apply to\n\nany duly-licensed physician authorized to practice medicine and/or\n\nsurgery under the laws of the State of Oklahoma and any business\n\nentity authorized to practice medicine or optometry in the State of\n\nOklahoma. Any administrative order or settlement agreement imposing\n\na civil administrative penalty pursuant to this section may be\n\nenforced in the same manner as civil judgments in this state. The\n\nBoard may file an application to enforce an administrative order or\n\nsettlement agreement in the district court of Oklahoma County. Any\n\nperson aggrieved by a final agency order of the Board may obtain\n\njudicial review in accordance with the Oklahoma Administrative\n\nProcedures Act. All money received as civil administrative\n\npenalties shall be placed in the operational account of the Board.\n\nC. Nothing in the provisions of Sections 581 through 604 of\n\nthis title shall prohibit the performance of routine visual\n\nscreening by a person not licensed to practice optometry in this\n\nstate. Nothing in this section shall prohibit an optometry student\n\nofficially enrolled in a college of optometry which is approved by\n\nthe State Regents for Higher Education from performing educational\n\nfunctions within the institution or prohibit an instructor in such\n\noptometry college from practicing optometry so long as such\n\npractitioner is licensed in any state and his or her practice is\nt\n\nofficially enrolled in a college of optometry which is approved by\n\nthe State Regents for Higher Education from performing educational\n\nfunctions within the institution or prohibit an instructor in such\n\noptometry college from practicing optometry so long as such\n\npractitioner is licensed in any state and his or her practice is\n\nlimited to instruction of optometry students in an accredited\n\nOklahoma college of optometry or state or federal hospital which is\n\nutilized as a teaching institution for students of optometry,\n\nprovided such instructor has been issued a temporary license by the\n\nOklahoma Board of Examiners in Optometry.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fdecc2d3455e1674d1b36abe7fcf8fe374e5188da83737ddc2f4145245adc0c5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-587","next":"us-ok/okla.-stat.-tit.-59-59-589"},"notice":"GroundRules: Original legal text.
