Stat. tit. 59, § 59-6002","heading":"Prescriptions for epinephrine auto-injectors at Emergency","body":"Public Access Stations - Use of auto-injectors--Immunity from\n\nliability.\n\nA. As used in this section:\n\n1. \"Emergency public access station\" (EPAS) means a locked,\n\nsecure container for the storage of epinephrine auto-injectors under\n\nthe general oversight of a physician, which allows a lay rescuer to\n\nconsult with a physician in real time by audio, televideo or other\n\nsimilar means of electronic communication and, upon authorization of\n\nthe consulting physician, may be unlocked to make available the\n\nepinephrine auto-injector.\n\n2. \"Epinephrine auto-injector\" means a single-use device used\n\nfor the automatic injection of a premeasured dose of epinephrine\n\ninto the human body;\n\n3. \"Physician\" means a person licensed to practice medicine\n\npursuant to the provisions of the Oklahoma Allopathic Medical and\n\nSurgical Licensure and Supervision Act or the Oklahoma Osteopathic\n\nMedicine Act.\n\nB. 1. Notwithstanding any applicable provision of law to the\n\ncontrary, a physician may prescribe a stock of epinephrine auto-\n\ninjectors to any entity or organization for storage in an Emergency\n\nPublic Access Station (EPAS) or may place a stock of supply of\n\nepinephrine auto-injectors at any entity or organization in an EPAS\n\nin accordance with protocols established by the physician.\n\n2. A physician may provide consultation to the user of an EPAS\n\nand may make the epinephrine auto-injectors stored within available\n\nto the user in accordance with protocols established by the\n\nphysician.\n\n3. Any person may use an EPAS and may administer or provide\n\nepinephrine auto-injectors made available through the EPAS to a\n\nspecific individual believed in good faith to be experiencing\n\nanaphylaxis or the parent, guardian or caregiver of such individual.\n\nC. Any person, including any entity or organization at which an\n\nEPAS is located, a physician, and any user of an EPAS who undertakes\n\nin good faith any act or mission pursuant to this act shall not be\n\nliable for any injuries or related damages that result from any such\n\nact or omission; provided, such immunity shall not apply to acts or\n\nomissions constituting gross, willful or wanton negligence. This\n\nact shall not eliminate, limit or reduce any other immunity or\n\ndefense that may be available under state law.
