As used in this section:\n\n1. \"Appropriate licensing board\" means:\n\na. for an allopathic physician, physician assistant, or\n\nrespiratory care practitioner, the State Board of\n\nMedical Licensure and Supervision,\n\nb. for an osteopathic physician, the State Board of\n\nOsteopathic Examiners,\n\nc. for a registered nurse, licensed practical nurse, or\n\nAdvanced Practice Registered Nurse, the Oklahoma Board\n\nof Nursing, or\n\nd. for a perfusionist, the State Board of Examiners of\n\nPerfusionists; and\n\n2. \"Health care provider\" means an individual who holds a\n\nvalid, unexpired license or credential granted by another state or\n\nterritory that authorizes or qualifies the individual to perform\n\nacts that are substantially the same as the acts that any of the\n\nfollowing are licensed to perform:\n\na. an allopathic physician licensed under Section 480 et\n\nseq. of Title 59 of the Oklahoma Statutes,\n\nb. an osteopathic physician licensed under Section 620 et\n\nseq. of Title 59 of the Oklahoma Statutes,\n\nc. a physician assistant licensed under Section 519.1 et\n\nseq. of Title 59 of the Oklahoma Statutes,\n\nd. a registered nurse, licensed practical nurse, or\n\nAdvanced Practice Registered Nurse licensed under\n\nSection 567.1 et seq. of Title 59 of the Oklahoma\n\nStatutes,\n\ne. a respiratory care practitioner licensed under Section\n\n2026 et seq. of Title 59 of the Oklahoma Statutes, or\n\nf. a perfusionist licensed under Section 2051 et seq. of\n\nTitle 59 of the Oklahoma Statutes.\n\nB. The licensing staff of the appropriate licensing board may\n\ngrant a health care provider a temporary critical need license under\n\nthe following conditions:\n\n1. The health care provider provides health care services\n\nwithin his or her scope of practice:\n\na. only during the period covered by one of the\n\nfollowing:\n\n(1) a state of emergency declared by the Governor, or\n\n(2) a national emergency declared by the President of\n\nthe United States pursuant to Section 1621 of\n\nTitle 50 of the United States Code, and\n\nb. that are directly related to the particular emergency\n\nas described in subparagraph a of this paragraph;\n\n2. The health care provider holds a valid, unexpired license or\n\ncredential granted by another state or territory; and\n\n3. The health care provider is not currently under\n\ninvestigation and no restrictions or limitations are currently\n\nplaced on the health care provider's license or credential by the\n\nlicensing or credentialing state or territory or any other\n\njurisdiction.\n\nC. To apply for a temporary critical need license, the health\n\ncare provider must submit an application through a form developed by\n\nthe appropriate licensing board, which at minimum must contain an\n\nattestation by the applicant to abide by all state and federal\n\nstatutes and regulatory rules and the applicant's:\n\n1. Full name;\n\n2. Date of birth;\n\n3. Email address;\n\n4. Residential address;\n\n5. Temporary medical practice address;\n\n6. Area of practice or specialty or level of licensure or\n\ncredentialing;\n\n7. Practice status in any state or territory where the\n\napplicant has been licensed or credentialed or currently holds a\n\nlicense or credential to practice the type of health care services\n\nfor which the applicant is seeking temporary critical need licensure\n\nunder this section; and\n\n8. Social Security number.\n\nD. Any temporary critical need license granted under this\n\nsection to a health care provider shall expire ninety (90) days\n\nafter the expiration of the state or national emergency declaration.\n\nE. Nothing in this section shall be construed to allow\n\nallopathic or osteopathic physicians or surgeons, physician\n\nassistants, or Advanced Practice Registered Nurses with prescriptive\n\nauthority who are issued a temporary critical need license to\n\ninitiate a prescription for controlled dangerous substances\nre ninety (90) days\n\nafter the expiration of the state or national emergency declaration.\n\nE. Nothing in this section shall be construed to allow\n\nallopathic or osteopathic physicians or surgeons, physician\n\nassistants, or Advanced Practice Registered Nurses with prescriptive\n\nauthority who are issued a temporary critical need license to\n\ninitiate a prescription for controlled dangerous substances\n\nincluding but not limited to opioids without:\n\n1. Obtaining the proper registration from the Oklahoma State\n\nBureau of Narcotics and Dangerous Drugs Control under Section 2-301\n\net seq. of Title 63 of the Oklahoma Statutes and the proper\n\nregistration from the United States Drug Enforcement Administration;\n\n2. Complying with all requirements pertaining to the access of\n\nprescription monitoring information from the central repository as\n\nprovided by the Anti-Drug Diversion Act, Section 2-309A et seq. of\n\nTitle 63 of the Oklahoma Statutes; and\n\n3. Complying with all other laws pertaining to the prescription\n\nof controlled dangerous substances.\n\nF. Nothing in this section shall be construed to allow\n\nallopathic or osteopathic physicians or surgeons who are issued a\n\ntemporary critical need license to recommend medical marijuana.\n\nG. Any temporary critical need license issued under this\n\nsection shall be ratified by the appropriate licensing board at the\n\nnext regular meeting of the board.\n\nH. Each appropriate licensing board may charge a fee for the\n\nissuance of a temporary critical need license under this section.\n\nI.
