Stat. tit. 59, § 59-622","heading":"License required - Submission to jurisdiction of courts -","body":"Employing hospitals not regarded as practitioners.\n\nA. 1. Except as otherwise provided by this section, it shall\n\nbe unlawful for any person to practice as an osteopathic physician\n\nand surgeon in this state, without a license to do so, issued by the\n\nState Board of Osteopathic Examiners; provided, that any license or\n\ncertificate issued under the laws of this state, authorizing its\n\nholder to practice osteopathic medicine, shall remain in full force\n\nand effect. Persons who hold themselves out as osteopathic\n\nphysicians in this state without a license issued by the State Board\n\nof Osteopathic Examiners shall submit themselves to the jurisdiction\n\nof the State Board of Osteopathic Examiners.\n\n2. Osteopathic physicians engaged in postgraduate training\n\nshall be licensed. Osteopathic physicians engaged in the internship\n\nor PGY-1 year shall be issued a resident training license and all\n\nother postgraduate students shall be issued an advanced resident\n\ntraining license.\n\nB. 1. A person within or outside of this state who performs\n\nthrough electronic communications diagnostic or treatment services\n\nor other medical services within the scope of practice of an\n\nosteopathic physician and surgeon for any patient whose condition is\n\nbeing diagnosed or treated within this state shall be licensed in\n\nthis state, pursuant to the provisions of the Oklahoma Osteopathic\n\nMedicine Act. However, in such cases, a nonresident osteopathic\n\nphysician who, while located outside this state, consults on an\n\nirregular basis with a physician who is located in this state is not\n\nrequired to be licensed in this state.\n\n2. Any osteopathic physician who engages in the practice of\n\nmedicine or the prescription of drugs, devices, or treatments via\n\nelectronic means may do so only in the context of an appropriate\n\nphysician-patient relationship wherein a proper patient record is\n\nmaintained including, at the minimum, a current history and\n\nphysical.\n\n3. Any commissioned medical officer of the Armed Forces of the\n\nUnited States or medical officer of the United States Public Health\n\nService or the United States Department of Veterans Affairs, in the\n\ndischarge of official duties whose practice is confined entirely\n\nwithin federally controlled facilities, who is fully licensed to\n\npractice osteopathic medicine and surgery in one or more\n\njurisdictions of the United States shall not be required to be\n\nlicensed in this state pursuant to the Oklahoma Osteopathic Medicine\n\nAct, unless the person already holds an osteopathic medical license\n\nin this state pursuant to the Oklahoma Osteopathic Medicine Act. In\n\nsuch case, the medical officer shall be subject to the Oklahoma\n\nOsteopathic Medicine Act.\n\n4. A person who performs any of the functions covered by this\n\nsubsection submits themselves to the jurisdiction of the courts of\n\nthis state for the purposes of any cause of action resulting from\n\nthe functions performed.\n\nC. A hospital, as defined in Section 1-701 of Title 63 of the\n\nOklahoma Statutes, or a related institution which has the principal\n\npurpose or function of providing hospital or medical care including,\n\nbut not limited to, any corporation, association, trust, or other\n\norganization organized and operated for such purpose, may employ one\n\nor more persons who are duly licensed to practice osteopathic\n\nmedicine in this state without being regarded as itself practicing\n\nosteopathic medicine within the meaning and provisions of this\n\nsection. The employment by the hospital or related institution of\n\nany person who is duly licensed shall not, in and of itself, be\n\nconsidered as an act of unprofessional conduct by the person so\n\nemployed. Nothing provided herein shall eliminate, limit or\n\nrestrict the liability for any act or failure to act of any\n\nhospital, any hospital’s employees or persons duly licensed to\n\npractice osteopathic medicine.\nemployment by the hospital or related institution of\n\nany person who is duly licensed shall not, in and of itself, be\n\nconsidered as an act of unprofessional conduct by the person so\n\nemployed. Nothing provided herein shall eliminate, limit or\n\nrestrict the liability for any act or failure to act of any\n\nhospital, any hospital’s employees or persons duly licensed to\n\npractice osteopathic medicine.\n\nD. Nothing in the Oklahoma Osteopathic Medicine Act shall be\n\nconstrued as to require an osteopathic physician to secure an\n\nOsteopathic Continuous Certification (OCC) as a condition of\n\nlicensure, reimbursement, employment or admitting privileges at a\n\nhospital in this state. For the purposes of this subsection,\n\n“Osteopathic Continuous Certification (OCC)” shall mean a continuing\n\neducation program measuring core competencies in the practice of\n\nmedicine and surgery and approved by a nationally-recognized\n\naccrediting organization.\n\nE. An osteopathic physician licensed under the Oklahoma\n\nOsteopathic Medicine Act may not hold himself or herself out as a\n\nboard-certified specialist unless the osteopathic physician has\n\nsuccessfully completed the requirements for certification by the\n\nAmerican Osteopathic Association, the American Board of Medical\n\nSpecialties, or the American Association of Physician Specialists.\n\nHowever, an osteopathic physician may indicate the services offered\n\nand may state that his or her practice is limited to one or more\n\ntypes of services when this statement accurately reflects the scope\n\nof practice of the osteopathic physician.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b5513dc78ab5623136a0662f1f09ffe38e31a85423fccf414e9456e61d5efc8e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-621","next":"us-ok/okla.-stat.-tit.-59-59-623"},"notice":"GroundRules: Original legal text.
