All osteopathic physicians in active practice licensed by\n\nthe State Board of Osteopathic Examiners shall maintain a policy for\n\nprofessional malpractice liability insurance; provided, however,\n\nthat such requirement shall not apply to osteopathic physicians:\n\n1. Covered by a group or hospital malpractice liability\n\ninsurance policy;\n\n2. Practicing in a state facility subject to The Governmental\n\nTort Claims Act, Section 151 et seq. of Title 51 of the Oklahoma\n\nStatutes;\n\n3. Practicing in a federal facility subject to the Federal Tort\n\nClaims Act;\n\n4. Providing care as a volunteer under a special volunteer\n\nmedical license pursuant to Section 635.1 of Title 59 of the\n\nOklahoma Statutes or a temporary critical need license under Section\n\n6011 of Title 59 of the Oklahoma Statutes;\n\n5. Providing care as a retired osteopathic physician with a\n\nvalid license in a volunteer, nonpaid capacity;\n\n6. Practicing or residing in another state or country, who will\n\nnot practice within this state during the license renewal year. An\n\nosteopathic physician that is residing but not practicing in this\n\nstate but wishes to maintain an active license may sign an affidavit\n\nstating that the osteopathic physician is not practicing osteopathic\n\nmedicine, listing the specific dates during which the osteopathic\n\nphysician will not practice. The osteopathic physician must notify\n\nthe Board in writing and provide proof of malpractice liability\n\ninsurance no fewer than ten (10) days prior to resuming practice; or\n\n7. Who petition the Board to be temporarily exempted due to\n\nhealth, injury, or other personal exigent circumstance during the\n\nyear, if the Board approves such petition. A signed and sworn\n\naffidavit and other documentation may be required by the Board. The\n\nBoard at its discretion may exempt an osteopathic physician for a\n\nspecific stated period of time.\n\nB.
