An assessment mechanism to conduct an eye assessment or to\n\ngenerate a prescription for contact lenses or visual aid glasses to\n\na patient in Oklahoma shall:\n\n1. Provide synchronous or asynchronous interaction between the\n\npatient and the Oklahoma-licensed optometrist;\n\n2. Collect the patient's medical history, previous prescription\n\nfor corrective eyewear and length of time since the patient's most\n\nrecent in-person comprehensive eye health examination;\n\n3. Provide any applicable accommodation required by the federal\n\nAmericans with Disabilities Act, 42 U.S.C. Sec. 12101 et seq., as\n\namended;\n\n4. Gather and transmit protected health information in\n\ncompliance with the federal Health Insurance Portability and\n\nAccountability Act of 1996, as amended;\n\n5. Be used to perform a procedure with a recognized Current\n\nProcedural Terminology code maintained by the American Medical\n\nAssociation, if applicable; and\n\n6. Maintain liability insurance, through its owner or lessee,\n\nin an amount adequate to cover claims made by individuals examined,\n\ndiagnosed, or treated based on information and data, including any\n\nphotographs, and scans, and other digital data generated by the\n\nassessment mechanism.\n\nB. An Oklahoma-licensed optometrist shall:\n\n1. Read and interpret the diagnostic information and data,\n\nincluding any photographs and scans, gathered by the assessment\n\nmechanism;\n\n2. Verify the identity of the patient requesting treatment via\n\nthe assessment mechanism;\n\n3. Create and maintain a medical record for each patient, which\n\nis for use during the ongoing treatment of a patient and complies\n\nwith all state and federal laws regarding maintenance and\n\naccessibility and is HIPAA-compliant; and\n\n4. Provide a handwritten or electronic signature, along with\n\ntheir Oklahoma state license number, certifying their diagnosis,\n\nevaluation, treatment of the patient, and prescription or\n\nconsultation recommendations for the patient.\n\nC. Prior to using an assessment mechanism, each Oklahoma\n\npatient shall be provided with and shall accept as a term of use a\n\ndisclosure that includes the following information:\n\n1. This assessment is not a replacement for an in-person\n\ncomprehensive eye health examination;\n\n2. This assessment cannot be used to generate an initial\n\nprescription for contact lenses or a follow-up or first renewal of\n\nthe initial prescription;\n\n3. This assessment may only be used if the patient has had an\n\nin-person comprehensive eye health examination within the previous\n\ntwenty-four (24) months if the patient is conducting an eye\n\nassessment or receiving a prescription for visual aid glasses; and\n\n4. The United States Centers for Disease Control and Prevention\n\n(CDC) advises contact lens wearers to be examined by an eye doctor\n\none time a year or more often if needed.\n\nD. Evaluation, treatment and consultation recommendations by an\n\nOklahoma-licensed optometrist utilizing an assessment mechanism as\n\nrequired in this section, including issuing a prescription via\n\nelectronic means, shall be held to the same standards of appropriate\n\npractice guidelines and standard of care as those in traditional in-\n\nperson clinical settings.\n\nE. This section shall not:\n\n1. Limit the discretion of an Oklahoma-licensed optometrist to\n\ndirect a patient to utilize any telehealth service deemed\n\nappropriate for any treatment and care of the patient;\n\n2. Limit the sharing of patient information, in whatever form,\n\nby an optometrist; or\n\n3.
