Stat. tit. 59, § 59-646.5","heading":"Verification of contact lens prescription by authorized","body":"sellers.\n\nA. All contact lens sellers authorized to dispense contact\n\nlenses in this state shall verify the contact lens prescription by\n\nthe following:\n\n1. Receipt of a written or faxed valid contact lens\n\nprescription signed by the prescribing optometrist; or\n\n2. An electronic or oral affirmative communication of the\n\ncomplete contact lens prescription from the prescribing optometrist.\n\nB. If a contact lens seller authorized to dispense contact\n\nlenses in this state finds it necessary to contact the prescribing\n\noptometrist via telephone in order to verify a contact lens\n\nprescription, the following protocols shall be followed:\n\n1. Calls shall be made during regular business hours, which for\n\npurposes of this act shall be defined as Monday through Friday\n\nduring the hours of 9:00 a.m. and 5:00 p.m. Central Standard Time\n\nexcluding federal holidays;\n\n2. Any verification requests shall include the name, address\n\nand telephone number of the patient;\n\n3. The toll-free telephone number shall be included in voice\n\nmail or messages left on answering machines;\n\n4. Contact lens prescriptions shall not be mailed, sent,\n\ndelivered or dispensed before verification by the optometrist;\n\n5. Touch-tone telephone options offered by a contact lens\n\nseller or any person authorized to dispense contact lenses in this\n\nstate shall not constitute verification;\n\n6. Response-time options stated by a contact lens seller or any\n\nperson authorized to dispense contact lenses in this state shall not\n\nconstitute verification; and\n\n7. Calls shall comply with federal statutes.\n\nC.
