Stat. tit. 59, § 59-858-301","heading":"License required – Exceptions","body":"It shall be unlawful for any person to act as a real estate\n\nlicensee, or to hold himself or herself out as such, unless the\n\nperson shall have been licensed to do so under the Oklahoma Real\n\nEstate License Code. For the purposes of this section, it shall be\n\nconsidered acting as a real estate licensee for any person,\n\npartnership, trust, association, limited liability company, or\n\ncorporation, or the partners, officers or employees of any\n\npartnership, trust, association, limited liability company, or\n\ncorporation, to publicly market for sale an equitable interest in a\n\ncontract for the purchase of real property between a property owner\n\nand a prospective purchaser. However, nothing in this section\n\nshall:\n\n1. Prevent any person, partnership, trust, association, limited\n\nliability company, or corporation, or the partners, officers or\n\nemployees of any partnership, trustees or beneficiaries of any\n\ntrust, association, limited liability company, or corporation, from:\n\na. acquiring real estate for its own use,\n\nb. selling, renting, leasing, exchanging, or offering to\n\nsell, rent, lease, or exchange any real estate so\n\nowned or leased as the owner, lessor, or lessee, or\n\nc. performing any acts with respect to such real estate\n\nwhen such acts are performed in the regular course of,\n\nor as an incident to, the management, ownership, or\n\nsales of such real estate and the investment therein;\n\nhowever, it shall be prohibited for any person,\n\npartnership, trust, association, limited liability\n\ncompany, or corporation, or the officers or employees\n\nof any partnership, trustees, or beneficiaries of any\n\ntrust, association, limited liability company, or\n\ncorporation to publicly market for sale an equitable\n\ninterest in a contract for the purchase of real\n\nproperty between a property owner and a prospective\n\npurchaser without holding an active real estate\n\nlicense;\n\n2. Apply to persons acting as the attorney-in-fact for the\n\nowner of any real estate authorizing the final consummation by\n\nperformance of any contract for the sale, lease or exchange of such\n\nreal estate;\n\n3. In any way prohibit any attorney-at-law from performing the\n\nduties of the attorney as such, nor shall this Code prohibit a\n\nreceiver, trustee in bankruptcy, administrator, executor, or his or\n\nher attorney, from performing his or her duties, or any person from\n\nperforming any acts under the order of any court, or acting as a\n\ntrustee under the terms of any trust, will, agreement or deed of\n\ntrust;\n\n4. Apply to any person acting as the resident manager for the\n\nowner or an employee acting as the resident manager for a licensed\n\nreal estate broker managing an apartment building, duplex, apartment\n\ncomplex or court, when such resident manager resides on the premises\n\nand is engaged in the leasing of property in connection with the\n\nemployment of the resident manager;\n\n5. Apply to any person who engages in such activity on behalf\n\nof a corporation or governmental body, to acquire easements, rights-\n\nof-way, leases, permits and licenses, including any and all\n\namendments thereto, and other similar interests in real estate, for\n\nthe purpose of, or facilities related to, transportation,\n\ncommunication services, cable lines, utilities, pipelines, or oil,\n\ngas, and petroleum products;\n\n6. Apply to any person who engages in such activity in\n\nconnection with the acquisition of real estate on behalf of an\n\nentity, public or private, which has the right to acquire the real\n\nestate by eminent domain;\n\n7. Apply to any person who is a resident of an apartment\n\nbuilding, duplex, or apartment complex or court, when the person\n\nreceives a resident referral fee. As used in this paragraph, a\n\n“resident referral fee” means a nominal fee not to exceed One\n\nHundred Dollars ($100.00), offered to a resident for the act of\nublic or private, which has the right to acquire the real\n\nestate by eminent domain;\n\n7. Apply to any person who is a resident of an apartment\n\nbuilding, duplex, or apartment complex or court, when the person\n\nreceives a resident referral fee. As used in this paragraph, a\n\n“resident referral fee” means a nominal fee not to exceed One\n\nHundred Dollars ($100.00), offered to a resident for the act of\n\nrecommending the property for lease to a family member, friend, or\n\ncoworker;\n\n8. Apply to any person or entity managing a transient lodging\n\nfacility. For purposes of this paragraph, “transient lodging\n\nfacility” means a furnished room or furnished suite of rooms which\n\nis rented to a person on a daily basis, not as a principal\n\nresidence, for a period less than thirty (30) days; or\n\n9. Apply to employees of a licensed real estate broker who\n\nlease residential housing units only to eligible persons who qualify\n\nthrough a state or federal housing subsidized program to lease the\n\nproperty in an affordable housing development project. “Affordable\n\nhousing development project” means a housing development of four or\n\nmore units constructed for lease to specifically eligible persons as\n\nrequired by the particular federal or state housing program,\n\nincluding, but not limited to, the U.S. Department of Housing and\n\nUrban Development, the U.S. Department Agriculture Rural\n\nDevelopment, the U.S. Department of Treasury Internal Revenue\n\nService, or the Oklahoma Housing Finance Agency.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"050356d3502e4f0597d07821e7e9ce67aafc2eccabb9430eddef87fbed533549","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-858-209","next":"us-ok/okla.-stat.-tit.-59-59-858-301.1"},"notice":"GroundRules: Original legal text.
