Stat. tit. 59, § 59-858-401","heading":"Penalties - Fines - Injunctions and restraining orders","body":"- Appeals.\n\nA. In addition to any other penalties provided by law, any\n\nperson unlicensed pursuant to The Oklahoma Real Estate License Code\n\nwho shall willingly, knowingly, or negligently violate any provision\n\nof this Code, upon conviction, shall be guilty of a misdemeanor\n\npunishable by a fine of not more than Five Thousand Dollars\n\n($5,000.00), or by imprisonment in the county jail for not more than\n\nsix (6) months, or by both such fine and imprisonment.\n\nB. In addition to any civil or criminal actions authorized by\n\nlaw, whenever, in the judgment of the Oklahoma Real Estate\n\nCommission, any unlicensed person has engaged in any acts or\n\npractices which constitute a violation of the Oklahoma Real Estate\n\nLicense Code, the Commission may:\n\n1. After notice and hearing, and upon finding a violation of\n\nthe Code, impose a fine of not more than Five Thousand Dollars\n\n($5,000.00) or the amount of the commission or commissions earned,\n\nwhichever is greater for each violation of the Code for unlicensed\n\nactivity;\n\n2. Make application to the appropriate court for an order\n\nenjoining such acts or practices, and upon a showing by the\n\nCommission that such person has engaged in any such acts or\n\npractices, an injunction, restraining order, or such other order as\n\nmay be appropriate shall be granted by such court, without bond; or\n\n3. Impose administrative fines pursuant to this subsection\n\nwhich shall be enforceable in the district courts of this state.\n\nThe order of the Commission shall become final and binding on all\n\nparties unless appealed to the district court as provided in the\n\nAdministrative Procedures Act. If an appeal is not made, such order\n\nmay be entered on the judgment docket of the district court in a\n\ncounty in which the debtor has property and thereafter enforced in\n\nthe same manner as an order of the district court for collection\n\nactions.\n\nC. Notices and hearings required by this section and any\n\nappeals from orders entered pursuant to this section shall be in\n\naccordance with the Administrative Procedures Act.\n\nD.
