Stat. tit. 59, § 59-858-513","heading":"Psychologically impacted real estate - Factors","body":"included - Nondisclosure of facts - Certain actions prohibited -\n\nDisclosure in certain circumstances.\n\nA. The fact or suspicion that real estate might be or is\n\npsychologically impacted, such impact being the result of facts or\n\nsuspicions, including but not limited to:\n\n1. That an occupant of the real estate is, or was at any time\n\nsuspected to be infected, or has been infected, with Human\n\nImmunodeficiency Virus or diagnosed with Acquired Immune Deficiency\n\nSyndrome, or other disease which has been determined by medical\n\nevidence to be highly unlikely to be transmitted through the\n\noccupancy of a dwelling place; or\n\n2. That the real estate was, or was at any time suspected to\n\nhave been the site of a suicide, homicide or other felony,\n\nis not a material fact that must be disclosed in a real estate\n\ntransaction.\n\nB. No cause of action shall arise against an owner of real\n\nestate or any licensee assisting the owner for the failure to\n\ndisclose to the purchaser or lessee of such real estate or any\n\nlicensee assisting the purchaser or lessee that such real estate was\n\npsychologically impacted as provided for in subsection A of this\n\nsection.\n\nC. Notwithstanding the fact that this information is not a\n\nmaterial defect or fact, in the event that a purchaser or lessee,\n\nwho is in the process of making a bona fide offer, advises the\n\nlicensee assisting the owner, in writing, that knowledge of such\n\nfactor is important to the person's decision to purchase or lease\n\nthe property, the licensee shall make inquiry of the owner and\n\nreport any findings to the purchaser or lessee with the consent of\n\nthe owner and subject to and consistent with applicable laws of\n\nprivacy; provided further, if the owner refuses to disclose, the\n\nlicensee assisting the owner shall so advise the purchaser or\n\nlessee.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"edc53a548ce4cdde6b040cf3601e306554e51461e7eb17f2871e62076d3af4c6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-858-503","next":"us-ok/okla.-stat.-tit.-59-59-858-514"},"notice":"GroundRules: Original legal text.
