In connection with any real estate transaction, the size or\n\narea, in square footage or otherwise, of the subject property shall\n\nnot be required to be provided by any real estate licensee, and if\n\nprovided, shall not be considered any warranty or guarantee of the\n\nsize or area information, in square footage or otherwise, of the\n\nsubject property.\n\nB. 1. If a real estate licensee provides any party to a real\n\nestate transaction with third-party information concerning the size\n\nor area, in square footage or otherwise, of the subject property\n\ninvolved in the transaction, the licensee shall identify the source\n\nof the information.\n\n2. For the purposes of this subsection, “third-party\n\ninformation” means:\n\na. an appraisal or any measurement information prepared\n\nby a licensed appraiser,\n\nb. a survey or developer’s plan prepared by a licensed\n\nsurveyor,\n\nc. a tax assessor's public record,\n\nd. a builder’s plan used to construct or market the\n\nproperty, or\n\ne. a plan, drawing or stated square footage provided by\n\nthe owner or agent of the owner, as it relates to\n\ncommercial buildings or structures for sale or for\n\nlease only. Commercial land shall be verified by one\n\nof the methods provided for in subparagraphs a through\n\nd of this paragraph.\n\nC. A real estate licensee has no duty to the seller or\n\npurchaser of real property to conduct an independent investigation\n\nof the size or area, in square footage or otherwise, of a subject\n\nproperty, or to independently verify the accuracy of any third-party\n\ninformation as such term is defined in paragraph 2 of subsection B\n\nof this section.\n\nD. A real estate licensee who has complied with the\n\nrequirements of this section, as applicable, shall have no further\n\nduties to the seller or purchaser of real property regarding\n\ndisclosed or undisclosed property size or area information, and\n\nshall not be subject to liability to any party for any damages\n\nsustained with regard to any conflicting measurements or opinions of\n\nsize or area, including exemplary or punitive damages.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"481253f0bac6854bff996819c09c65b014a6978c53056b3ed457fec98f63f59d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-858-514","next":"us-ok/okla.-stat.-tit.-59-59-858-515.2"},"notice":"GroundRules: Original legal text.
