Stat. tit. 59, § 59-858-515.2","heading":"Violation of duty to disclose source of information","body":"- Damages.\n\nA. If a real estate licensee has provided any third-party\n\ninformation, as defined in paragraph 2 of subsection B of Section 1\n\nof this act, to any party to a real estate transaction concerning\n\nsize or area of the subject real property, a party to the real\n\nestate transaction may recover damages from the licensee in a civil\n\naction only when a licensee knowingly violates the duty to disclose\n\nthe source of the information, as required in paragraph 1 of\n\nsubsection B of Section 1 of this act.\n\nB. The sole and exclusive civil remedy at common law or\n\notherwise for a violation of paragraph 1 of subsection B of Section\n\n1 of this act by a real estate licensee shall be an action for\n\nactual damages suffered by the party as a result of such violation\n\nand shall not include exemplary or punitive damages.\n\nC. For any real estate transaction commenced after the\n\neffective date of this act, any civil action brought pursuant to\n\nthis section shall be commenced within two (2) years after the date\n\nof transfer of the subject real property.\n\nD. In any civil action brought pursuant to this section, the\n\nprevailing party shall be allowed court costs and reasonable\n\nattorney fees to be set by the court and collected as costs of the\n\naction.\n\nE. A transfer of a possessory interest in real property subject\n\nto the provisions of this act may not be invalidated solely because\n\nof the failure of any person to comply with the provisions of this\n\nact.\n\nF. The provisions of this act shall apply to, regulate and\n\ndetermine the rights, duties, obligations and remedies, at common\n\nlaw or otherwise, of the seller marketing his or her real property\n\nfor sale through a real estate licensee, and of the purchaser of\n\nreal property offered for sale through a real estate licensee, with\n\nrespect to disclosure of third-party information concerning the\n\nsubject real property’s size or area, in square footage or\n\notherwise, and this act hereby supplants and abrogates all common\n\nlaw liability, rights, duties, obligations and remedies of all\n\nparties therefor.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c7e892dbbcb568ac4245e8bdaf77cc2a9e662728eabeb092d6f1529ba1d81f8e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-858-515.1","next":"us-ok/okla.-stat.-tit.-59-59-858-601"},"notice":"GroundRules: Original legal text.
