Stat. tit. 59, § 59-858-627","heading":"Rule promulgation - Disciplinary measures - Injunctive","body":"relief and restraining orders.\n\nA. The Committee of Home Inspector Examiners shall advise the\n\nConstruction Industries Board in promulgating rules consistent with\n\nthe purposes of the Home Inspection Licensing Act.\n\nB. The Construction Industries Board shall promulgate rules\n\nincluding, but not limited to:\n\n1. Qualifications and examinations for licensure of home\n\ninspectors;\n\n2. License renewal requirements;\n\n3. Reinstatement of license after suspension or revocation of\n\nlicense or failure to meet license renewal requirements;\n\n4. Continuing education;\n\n5. Standards of practice and prohibited acts;\n\n6. Approval of schools, educational course content,\n\ninstructors, and organizations offering courses of study for home\n\ninspection;\n\n7. Standards required for schools, instructors, and\n\norganizations to remain approved;\n\n8. Approval fees;\n\n9. Reciprocity agreements whereby home inspectors licensed in\n\nother states with equal or greater licensure requirements may be\n\nlicensed in this state, and fee for licensing by reciprocity; and\n\n10. Investigative procedures.\n\nC. Upon showing of good cause as provided for in the Home\n\nInspection Licensing Act, the Board shall discipline licensees,\n\napproved instructors, approved schools, and educational\n\norganizations by:\n\n1. Issuing reprimands;\n\n2. Requiring probation for a specified period of time;\n\n3. Requiring education in addition to the educational\n\nrequirements provided for licensure or continuing education;\n\n4. Suspending licenses or approvals;\n\n5. Rescinding or revoking licenses or approvals;\n\n6. Imposing administrative fines as provided for by the Home\n\nInspection Licensing Act;\n\n7. Any combination of disciplinary measures as provided by\n\nparagraphs 1 through 6 of this subsection; and\n\n8. Upon showing of good cause, may modify any disciplinary\n\naction imposed pursuant to the provisions of the Home Inspection\n\nLicensing Act.\n\nD. The Committee may advise the Board to seek injunctive relief\n\nand restraining orders for violations of the Home Inspection\n\nLicensing Act or the rules promulgated pursuant thereto to cause the\n\nprosecution of any person who violates any of the provisions of the\n\nHome Inspection Licensing Act or the rules promulgated pursuant\n\nthereto.\n\nE.
