The Committee of Home Inspector Examiners may, upon its own\n\nmotion, and shall, upon written complaint filed by any person,\n\ndirect the Construction Industries Board to investigate the business\n\nactivities of any home inspector. The Committee may contract for an\n\nadministrative judge for any hearing which may, upon a showing of\n\ngood cause, impose disciplinary actions as provided in the Home\n\nInspection Licensing Act.\n\nB. Good cause shall be established upon showing that any\n\nlicensee has performed, is performing, has attempted to perform, or\n\nis attempting to perform any of the following acts:\n\n1. Making a materially false or fraudulent statement in an\n\napplication for license or for approval of continuing education;\n\n2. Having been convicted in a court of competent jurisdiction\n\nof forgery, fraud, conspiracy to defraud, or any similar offense, or\n\npleading guilty or nolo contendere to any such offense;\n\n3. Falsifying or failing to disclose in a home inspection\n\nreport a material defect;\n\n4. Failing to perform a home inspection report in accordance\n\nwith the Home Inspection Licensing Act or the rules promulgated\n\npursuant thereto;\n\n5. Compensating any person for performing the services of a\n\nhome inspector or lending a license to any person who has not first\n\nsecured a license as a home inspector pursuant to the Home\n\nInspection Licensing Act;\n\n6. Accepting inspection assignments when the employment itself\n\nis contingent upon reporting a predetermined estimate, analysis or\n\nopinion;\n\n7. Accepting inspection assignments when the fee to be paid is\n\ncontingent upon the opinion, the conclusion, analysis, or report\n\nreached, or upon the consequences resulting from such assignments;\n\n8. Performing repair or maintenance work, or receiving\n\ncompensation either directly or indirectly from a company regularly\n\nengaged in home repair work, on a property having four or fewer\n\ndwelling units that the home inspector inspected within one (1) year\n\nfrom the date of the inspection;\n\n9. Accepting compensation from more than one client for a\n\nsingle home inspection, unless the home inspector has informed all\n\nclients who are paying a fee for that home inspection that such\n\ncompensation is sought or anticipated;\n\n10. Except as provided in paragraph 14 of this subsection,\n\ndisclosing the results of a home inspection to any person other than\n\nthe client without the written consent of the client;\n\n11. Failing to disclose to the client any conflict of interest\n\nof which the inspector knows or should have known that may adversely\n\naffect the client;\n\n12. Failing to submit a written home inspection report within a\n\nreasonable time as determined by the Board to the client after\n\ncompensation has been paid to the home inspector;\n\n13. Paying any fees or other amounts due pursuant to the Home\n\nInspection Licensing Act or the rules promulgated pursuant thereto\n\nwith a check that is dishonored upon presentation to the financial\n\ninstitution on which it is drawn;\n\n14. Failing, upon demand in writing by the Construction\n\nIndustries Board, a law enforcement agency, or a court of law, to\n\ndisclose any information within the knowledge of the licensee or to\n\nproduce any document in possession of a licensee or under control of\n\na licensee that relates to a home inspection; or\n\n15.
