Stat. tit. 59, § 59-858-709","heading":"Applications for certification, renewal and","body":"examination - Fees - Pledge of compliance with Board standards -\n\nTemporary appraisers - Consent to suits and actions.\n\nA. Applications for original certification, renewal\n\ncertification and examinations shall be made in writing to the\n\nInsurance Department on forms approved by the Real Estate Appraiser\n\nBoard. Effective January 1, 2015, applicants for original\n\ncertification must submit to a criminal history records search that\n\ncomplies with Section 858-709A of this title.\n\nB. Appropriate fees, as fixed by the Department pursuant to\n\nSection 858-708 of this title, must accompany all applications for\n\nrenewal certification.\n\nC. At the time of filing an application for certification, each\n\napplicant shall sign a pledge to comply with the standards set forth\n\nin the Oklahoma Certified Real Estate Appraisers Act, and state that\n\nsuch applicant understands the types of misconduct for which\n\ndisciplinary proceedings may be initiated against an Oklahoma\n\ncertified real estate appraiser, as set forth in the Oklahoma\n\nCertified Real Estate Appraisers Act.\n\nD. In accordance with Section 3351 of Title 12 of the United\n\nStates Code, the Board shall recognize, on a temporary basis, the\n\ncertification or license of an appraiser issued by another state if:\n\n1. The property to be appraised is part of a federally related\n\ntransaction, as defined in the federal real estate appraisal reform\n\namendments;\n\n2. The appraiser's business is of a temporary nature and\n\ncertified by the appraiser;\n\n3. The appraiser registers the temporary practice with the\n\nBoard and pays fees as provided herein; and\n\n4. The appraiser resides in or is working out of a state that\n\nis also in compliance with Section 3351 of Title 12 of the United\n\nStates Code, that recognizes, on a temporary basis, the\n\ncertification or license of an Oklahoma appraiser in their state; or\n\n5. As otherwise approved by the Board.\n\nE. The applicant or any person registering with the Board for\n\ntemporary practice shall file an irrevocable consent that suits and\n\nactions may be commenced against such person:\n\n1. In the proper court of any county of this state in which a\n\ncause of action may arise due to the person's actions as a state\n\nlicensed or certified real estate appraiser; or\n\n2. In the county in which the plaintiff may reside.\n\nThe consent also shall stipulate and agree that service of\n\nprocess or pleadings on the person shall be made by service upon the\n\nBoard as the person's agent and held in all courts to be as valid\n\nand binding as if personal service had been made upon the applicant\n\nin Oklahoma. In case any processes or pleading mentioned in the\n\ncase is served upon the Board, it shall be by duplicate copies, one\n\nof which shall be filed with the Board's Director and the other\n\nimmediately forwarded by registered mail to the nonresident state\n\nlicensed or certified real estate appraiser to whom the processes or\n\npleadings are directed.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8fac3ae0f739f1fdefa54fd77bc7ffc58924d70e1cddadcb19297aeb9c80b40f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-858-708","next":"us-ok/okla.-stat.-tit.-59-59-858-709a"},"notice":"GroundRules: Original legal text.
